(1) के अधीन यथाअपेजक्षत प्रारूप जिजनयम अथाात् ऊिाा दक्षता ब्यरू ो (जचल् लसा के लेबल पर उनके संप्रदिान की जिजिजियां और रीजत) जिजनयम, 2022” को रािपत्र, असाधारण भाग 3, खंड 4 में अजधसूचना सं. बीईई /एसएंडएल/जचल् लसा/40/2022-23, तारीख 28 अक् तूबर, 2022 द्वारा प्रकाजित दकया गया था जिसमें ऐसे सभी व् यजियों से, जिनकी उससे प्रभाजित होने की संभािना थी उक् त अजधसूचना के रािपत्र में प्रकािन की तारीख से तीस ददनों की जिजनर्दाष् ट अिजध के भीतर आक्षेप या सुझाि आमंजत्रत दकए गए थे;

और उक् त प्रारूप जिजनयम की रािपजत्रत प्रजतयां िनता को 28 अक् तूबर, 2022 को उपलब् ध करा दी गई थीं; और पूिोक् त जिजनर्दाष् ट अिजध के भीतर उक् त प्रारूप जिजनयम के बाबत िनता से कजतपय आक्षेप और सुझाि प्राप्त हुए ह;ैं और इस बाबत प्राप्त सुझाि पर जिचार कर जलया गया है;

अत:, अब, ब् यूरो, केन्‍द रीय सरकार के पूिा अनुमोदन से ऊिाा संरक्षण अजधजनयम, 2001 (2001 का 52), की धारा 13 की उपधारा (2) के खंड (ढ) और धारा 14 के खंड (घ) के साथ पठित धारा 58 की उपधारा (2) के खंड (झ) द्वारा प्रदत् त िजियों का प्रयोग करते हुए, जनम् नजलजखत जिजनयम बनाता है, अथाात् :- 6020 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1. सजं क्षप्त नाम और प्रारंभ - (1) इन जिजनयमों का संजक्षप्त नाम ऊिाा दक्षता ब्यूरो (जचल्लसा के लेबल पर उनके संप्रदिान की जिजिजिया ं और रीजत) जिजनयम, 2023 ह।ै

(2) ये रािपत्र में इनके प्रकािन की तारीख से प्रिृत्त होंगे।

2. पठरभाषाएँ - (1) इन जिजनयमों में, िब तक संदभा में अन्‍दयथा अपेजक्षत न हो, - (क) "अजधजनयम" से ऊिाा संरक्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ह ै; (ख) "बेजसक मॉडल ग्रुप" से उन मॉडलों का समूह अजभप्रेत ह ैजिनकी जििेषताएं समान ह ैऔर िो एक मॉडल के प्रदिान को समूह के भीतर अन्‍दय मॉडलों के प्रदिान का प्रजतजनजधत् ि करते ह।ैं िीतलन क्षमता की एक जनजित सीमा के भीतर, एक बेजसक मॉडल ग्रुप में िे जचल् लर मॉडल सजम्मजलत होंगे, िो भारतीय आिताक ऊिाा दक्षता अनुपात के संदभा में समान ऊिाा प्रदिान के साथ एक ही स्ट्टार लेिल बैंड में रखे होंगे। (ग) "चाइल्ड मॉडल" से िह मॉडल अजभप्रेत है जिसकी कूललंग क्षमता दकलोिाट में होगी, िो उसी बेजसक मॉडल ग्रुप में मूल मॉडल की कूललंग क्षमता से कम होगी । (घ) "जचल् लसा" से अजधजनयम की धारा 14 के खंड (ख) के अधीन अजधसूचना में जिजनर्दाष् ट एक साजधत्र अजभप्रेत ह;ै (ड.) "प्ररूप" से इन जिजनयमों के साथ संलग्न कोई प्ररूप अजभप्रेत है;

(च) "लेबल" से दकसी भी जलजखत, मुदरत, जचजननत, मुरांदकत या रेखाजचत्रीय पदाथा अजभप्रेत है िो जचल् लर पर जचपकाया गया ह ैया उस पर ददखाई दे रहा है; (छ) "लेबल अिजध" से अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत जिद्युत उपभोग मानकों की जिजधमान्‍द यता अिजध अजभप्रेत ह:ै परंतु यदद लेबल जिजधमान्‍द यता अिजध की समाजप्त की समय-सीमा तक, अजधजनयम की धारा 14 (क) के अधीन नए जिद्युत उपभोग मानकों को अजधसजू चत नहीं दकया िाता है, जिद्यमान मानकों को तब तक जिजधमान्‍द य समझा िाएगा िब तक दक केन्‍दरीय सरकार द्वारा इसके जलए नए मान अजधसूजचत नहीं दकए िाते;

(ि) "पेरेंट मॉडल" से संबंजधत बेजसक मॉडल ग्रुप की िीतलन क्षमता सीमा के भीतर दकलोिाट में उच्चतम िीतलन क्षमता िाला एक जचल् लर मॉडल अजभप्रेत ह।ै (झ) "अनुज्ञापत्रधारी'' से एक व् यजि या अजभकरण अजभप्रेत ह ै जिसे जिजनयम 7 के अधीन लेबल जचपकाने की अनुज्ञा दी गई है;

(ञ) "अनुसूची" से इन जिजनयमों से उपाबद्ध अनुसूची अजभप्रेत है; (ट) "स्ट्टार रेटटंग या स्ट्टार स्ट् तर" से अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत आईएसईईआर के मानको के आधार पर जचल् लसा के लेबल पर संप्रदर्िात ऊिाा दक्षता की श्रेणी अजभप्रेत है;

(ि) दकसी जचल् लर के बाबत "व्यापारी या जिक्रेता" से एक ऐसा व्यजि अजभप्रेत ह ै िो ऐसे जचल् लर को बेचता ह ै या जितठरत करता ह ै और इसमें दकु ानदार, व्यापारी, जिजनमााता और अनुज्ञापत्रधारी सजम्मजलत ह ैं जिन्‍दह ें ऐसे जचल् लर पर लेबल जचपकाने की अनुज्ञा दी गई है।

(2) उन िब्द ों और पदों के, िो इसमें प्रयुक् त ह ैं और पठरभाजषत नहीं हैं, दकन्‍द तु अजधजनयम में पठरभाजषत हैं, िही अथा होंगे िो अजधजनयम में ह।ैं

3. लबे ल पर सप्रं दर्िता की िान ेिाली जिजिजिया ं (1) प्रत्येक जचल् लर पर जनम्नजलजखत जिजिजियां उनके लेबल पर संप्रदर्िात की िाएंगी अथाात् : - (क) ऊिाा दक्षता ब्यूरो का लोगो;[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3 (ख) साजधत्र या प्रकार;

(ग) जिजनमााता या आयातकताा का नाम और ब्ांड; (घ) बेजसक मॉडल ग्रुप या मॉडल और जिजनमााण या आयात का िषा; (ड.) यूजनक श्रृंखला कोड; (च) िीतलन प्रौद्योजगकी; (छ) संपीड़क प्रकार; (ि) िीतलन क्षमता; (झ) भारतीय आिताक ऊिाा दक्षता अनुपात;

(ञ) कुल जिद्युत इनपुट; (ट) लेबल की अिजध;

(2) लेबल का जडिाइन, रंग, आकार और जिषय-िस्ट्त ु इन जिजनयमों से उपाबद्ध अनुसूची में यथाजिजनर्दाष् ट होगी।

4. लबे ल सप्रं दर्िता करन े की समय-सीमा- (1) स्ट्िैजछछक से आज्ञापक व्यिस्ट्था तक पारगमन- जिजनयम 3 में जिजनर्दाि सभी जिजिजियों िाला एक लेबल इन जिजनयमों के प्रिृत् त होने की तारीख से छह मास की अिजध के भीतर प्रत्येक जचल् लर पर संप्रदर्िात दकया िाएगा।

(2) आज्ञापक ऊिा ा उपभोग मानकों का पनु रीक्षण- अजधजनयम की धारा 14 के खडं (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसजू चत पुनरीजक्षत जिद्युत उपभोग मानकों के प्रारंभ होन ेपर, प्रत्यके अनुज्ञापत्रधारी या व्यापारी या जिक्रेता;- (क) जपछले ऊिाा उपभोग मानकों िाले जचल् लर का उत्पादन नहीं करेगा;

(ख) पुनरीजक्षत ऊिाा उपभोग मानकों के साथ तुल् यकालन करते हुए पुनरीजक्षत ऊिाा उपभोग मानक के साथ पुनरीजक्षत स्ट्टार स्ट्तर और लेबल अिजध और जचल् लर का जिजनमाणा िषा संप्रदर्िात दकया िाएगा; परंतु सुचारू पारगमन के जलए, जिजनमााता पुनरीजक्षत ऊिाा जनष् पादन मानकों के साथ ऐसे प्रारंभ की तारीख से दो मास पहले उत्पाद का उत्पादन या आयात करेगा;

(ग) व् यिहाठरयों, खुदरा जिक्रेताओं की िागरूकता, उनकी जिक्षा के साथ-साथ उपभोिाओं की जिक्षा के जलए अपेजक्षत प्रचार सजहत प्रारंजभक कदम सजु नयोजित हों और कारािाई तीन मास पहल ेकी गई िाए।

5. लेबल सप्रं दर्िता करन ेकी रीजत - (1) जबक्री के स्ट् थान पर प्रत् येक जचल् लर पर जनम् नजलजखत रीजत से लेबल चस्ट्प ा दकया िाएगा, अथाात्: - (क) लेबल जचल् लर पर और उसकी नामपठिका के पास मिबूती से चस्ट्प ा दकया िाएगा। (ख) लेबल ठटकाऊ सामग्री (एल्यूमीजनयम एनोडाइज्ड) का होगा और इस जिजनयम से उपाबद्ध अनुसूची म ेंददए गए आकार के अनुसार मुदरत दकया िाएगा।

(2) संक्षारण प्रजतरोधी सामग्री की नामपठिका जचल् लर पर जचपकाई िाएगी । अनुसूची द्वारा अपेजक्षत अंकन सुपाठ्य, अजमट और ठटकाऊ होने चाजहए।

6. लेबल सप्रं दर्िता करन े की अनज्ञु ा- (1) ब्यूरो की पूिा अनुज्ञा प्राप्त दकए जबना दकसी जचल् लर पर कोई स्ट्टार लेबल नहीं लगाया िाएगा ।4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) कंपनी रजिस्ट्र ीकरण - ब्यूरो की अनुज्ञा प्राप्त करने के प्रयोिनों के जलए, प्रत्येक ब्ांड प्ररूप 1 - (क) में यथाजनर्दाष् ट प्रथक रूप स े रजिस्ट्र ीकृत दकया िाएगा, जिसमें एक लाख रुपए का लेबल प्रजतभूजत फीस होगा, िो संदाय के दकसी भी स्ट् िीकाया इलेक् राजनक मोड द्वारा देय ह:ै परंतु लघु उद्योग के मामले में लेबल प्रजतभूजत फीस केिल पच्चीस हिार रुपए होगी;

(3) मॉडल रजिस्ट्र ीकरण- उप-जिजनयम (2) के अधीन अनुज्ञा के प्रत्येक आिेदन के साथ जनम् नजलजखत होंगे - (क) प्रजत मॉडल दो हिार रुपए की आिेदन फीस, िो संदाय के दकसी भी इलेक् रॉजनक मोड द्वारा देय ह;ै और (ख) प्ररूप-1 – (ख) में जिजनर्दाष् ट दस्ट् तािेि

7. अनज्ञु ा प्रदान करना. -(1) जिजनयम 6 के अधीन एक आिेदन प्राप्त होने पर और समाधान होने के पश् चात् दक सभी अपेक्षाओं का अनुपालन दकया गया ह,ै ब्यूरो, घरेलू उपकरणों में स्ट्टार लेबललंग का प्रसार अपने मैनुअल (ब्यूरो का मानकों और लेबललंग पर पठरचालन मैनुअल) में जिजनर्दाि अिजध के भीतर कर सकता है। ऐसी प्राजप्त, अनुदान की तारीख, जिजनयम 8 में यथाजनर्दाष् ट ऐसे जनबंधनों और ितों के अधीन हो सकेगा, िो - (क) ब्ांड को प्ररूप 2- (क) या इलेक्रॉजनक रूप में रजिस्ट्र ीकृत करें; तथा (ख) प्ररूप 2- (ख) या इलेक्रॉजनक रूप में जचल् लर पर लेबल लगाने की अनुज्ञा प्रदान करना।

(2) ब्यूरो प्ररूप 3 में जिजनर्दाष् ट एक रजिस्ट्टर बनायेगा और उसमें अनुज्ञापत्रधारी का नाम दिा करेगा।

(3) उपजिजनयम (1) के अधीन दी गई अनुज्ञा उस अिजध के जलए जिजधमान्‍द य होगी, जिसके जलए धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत जिद्युत उपभोग मानक द्वारा जिजनर्दाष् ट स्ट्टार स्ट्तर लागू ह।ै

(4) स्ट्टार रेटटंग योिना के पुनरीक्षण के मामले में, अनुज्ञा के निीनीकरण के जलए आिेदन अनुज्ञापत्रधारी द्वारा एक मास के जलए दकया िाएगा दकेंतु इसकी समाजप्त के पहले नहीं दकया िाएगा और ऊिाा दक्षता ब्यूरो, नई ददल्ली के पक्ष में इलेक्रॉजनक मोड में एक हिार रुपए की फीस के साथ देय होगा। परंतु, स्ट्टार रेटटंग योिना के जिस्ट्तार के मामले में, एक हिार रुपए की उि निीनीकरण फीस से छूट दी िाएगी।

(5) उपजिजनयम (4) के अधीन निीनीकरण के जलए आिेदन प्राप्त होने पर और समाधान होने के पश् चात् दक सभी अपेक्षाओं का अनुपालन दकया िाता है, ब्यूरो, ऐसी प्राजप्त की तारीख से एक मास की अिजध के भीतर, प्ररूप 2 - (ख) में अनुज्ञा का निीनीकरण कर सकेगा।

(6) जिजधमान्‍द यता अिजध की समाजप्त के पश् चात् दकसी भी आिेदन का निीनीकरण नहीं दकया िाएगा, ऐसी जस्ट्थजत में अनुज्ञापत्रधारी को नया आिेदन करना होगा।

(7) ऐसा अनुज्ञापत्रधारी िो उस तारीख से जचल् लर के जिद्यमान मॉडल पर लेबल जचपकाने के जलए अनुज्ञा चाहता है, जिस तारीख स े पुनरीजक्षत स्ट्टार स्ट्तर प्रिृत् त होता ह,ै िह प्ररूप 4 के अनुसार घोषणा प्रस्ट् तुत करेगा;

(8) अनुज्ञापत्रधारी नए जसरे से लेबल लगाने के जलए अनुज्ञा लेने का प्रयास करेगा, यदद जचल् लर के नए मॉडल पुनरीजक्षत स्ट्टार स्ट्तर के साथ तुल् यकालन दकया िाना ह,ै और ऐसी अनुज्ञा के जलए आिेदन पुनरीजक्षत स्ट्टार स्ट्तर के प्रिृत् त होने के छह मास पहले दकया िाएगा।

8.लेबल पर जिजिजियों को सप्रं दर्िता करन ेके जलए जनबधं न और ित:ें - प्रत्येक अनुज्ञापत्रधारी, जिक्रेता या व्यापारी लेबल पर जिजिजियां संप्रदर्िात करने में जनम्नजलजखत जनबंधनों और ितों का पालन करेगा, अथाात््ः -[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 (क) जचल् लर के लेबल पर संप्रदर्िात स्ट् टार लेबल अजधजनयम की धारा 14 के खंड (क) के अधीन अजधसूजचत ऊिाा उपभोग मानकों के अनुरूप होगा;

(ख) लेबल केिल जचल् लर के ऐसे मॉडल पर जचपकाया िाएगा जिसके जलए अनुज्ञा की मंिूरी दी गई है; (ग) अनुज्ञापत्रधारी अपनी लागत पर लेबल को जचल् लर पर जचपकाएगा; (घ) जचल् लर के लेबल पर संप्रदर्िात स्ट्ट ार लेबल सभी समय अनुरजक्षत रखा िाएगा;

(ड.) जिजनयम 9 में यथाजिजनर्दाष् ट लेबल फीस का संदाय करेगा; (च) लेबलीकृत उपस्ट्कर के उत्पादन के ब्यौरों से अंतर्िाि जिजिजियां और जित्तीय िषा की प्रत्येक जतमाही के आगामी समापन मास के भीतर प्रत्येक जतमाही के जलए देय उद्भूत फीस ब्यूरो को प्रस्ट्तुत की िाएगी;

(छ) प्रत्येक िषा अप्रैल मास के 30िें ददन तक अपने लेबल िाले उत्पादों के जिक्रय के जलए जनयुि प्राजधकृत जितरकों, व् यिहाठरयों, खुदरा जिक्रेताओं और जिक्रेताओं की एक अद्यतन सूची ब्यूरो को प्रस्ट्तुत की िाएगी; और (ि) ऐसे अन्‍दय जनबंधनों और ितों का अनुपालन दकया िाएगा जिन्‍दह ेंब्यूरो घरेलू उपकरणों के जलए िारी मानकों और लेबललंग पर ब्यूरो के प्रचालन मैनुअल में जनजहत जनबंधनों सजहत जिर्नाददि करेगा (ब्यूरो का मानकों और लेबललंग पर पठरचालन मैनुअल)।

9. लेबल फीस: - (1) प्रत्येक अनुज्ञापत्रधारी ब्यूरो को जचल् लर पर इस प्रकार जचपकाए गए लेबल पर तीन रुपए प्रजत दकलोिाट की लेबल फीस का संदाय करेगा।

(2) उपजिजनयम (1) के अधीन जिजनर्दाष् ट लेबल फीस प्रत्येक जित्तीय िषा की अंजतम तारीख से एक मास के भीतर िार्षाक रूप से संदाय की िाएगी्ः परन्‍दतु इस प्रकार जिजनर्दाष् ट अिजध के भीतर लेबल फीस का संदाय करने में असफल रहने पर जिजनयम 6 के उपजिजनयम (3) के खंड (क) के अधीन ब्यूरो लेबल प्रजतभूजत फीस उस पर दस प्रजतित की दर से ब्याि सजहत संदत्त िोध रकम िसूल कर सकेगा और यदद संदाय की अंजतम तारीख के एक िषा के भीतर लेबललंग फीस की कुल रकम की िसूली नहीं की िाती है, तो ब्यूरो अनुज्ञापत्रधारी को ददए गए सभी लेबलों को रद्द कर सकेगा और समाचार पत्रों में व् यजतक्रम के रूप में अनुज्ञापत्रधारी का नाम प्रकाजित कर सकेगा।

10. लेबल प्रजतभजू त फीस का प्रजतदाय्ः - जिजनयम 9 के उपजिजनयम (2) के परंतुक के अधीन, अनुज्ञापत्रधारी जचल् लर का जिजनमााण बदं करने पर लेबल प्रजतभूजत फीस के संदाय का हकदार होगा।

11. ब्यरू ो द्वारा सत्यापन- (1) जचल् लर जिजनमााता ऑनलाइन ऊिाा दक्षता ब् यूरो पोटाल में त्रैमाजसक रूप से स्ट्टार रेटटंग कायाक्रम के अधीन रजिस्ट्र ीकृत जचल् लर के बारे में जचल् लर उत्पादन कायाक्रम और जितरण कायाक्रम प्रस्ट्तुत करेगा ।

(2) जचल् लर का चेक परीक्षण या तो राष्ट्रीय परीक्षण और अंिांकन प्रयोगिाला प्रत्यायन बोडा द्वारा जिजधित मान्‍दयता प्राप्त जनमााता परीक्षण प्रयोगिाला में या राष्ट्रीय परीक्षण और अंिांकन प्रयोगिाला प्रत्यायन बोडा या दकसी अन्‍दय द्वारा जिजधित मान्‍दयता प्राप्त दकसी तीसरे पक्ष या स्ट्ितंत्र परीक्षण प्रयोगिाला या एजिया पेजसदफक प्रत्यायन सहयोग या अंतरााष्ट्रीय प्रयोगिाला प्रत्यायन सहयोग के साथ पारस्ट्पठरक मान्‍दयता प्राप्त जनकाय में दकया िाएगा।

(3) ऊिाा दक्षता ब् यूरो के प्रजतजनजध की उपजस्ट्थजत में राष्ट्रीय परीक्षण और अंििोधन प्रयोगिाला प्रत्यायन बोडा द्वारा जिजधित प्रत् यायन प्राप्त स्ट्ितंत्र परीक्षण प्रयोगिाला या इन-हाउस जिजनमााता की परीक्षण प्रयोगिाला में जचल् लर के जलए िांच परीक्षण आयोजित दकया िाएगा।

(4) ब्यूरो या उसकी नाजमत अजभकरण, या तो स्ट्ित: संज्ञान लेकर या उसके द्वारा प्राप्त जिकायत पर, यह सुजनजित करने के जलए सत्यापन परीक्षण कर सकती ह ैदक जचल् लर स्ट्टार स्ट्तर और उसके लेबल पर प्रदर्िात अन्‍दय जििरणों के अनुरूप ह ैऔर यह अनुज्ञा की अन्‍द य जनबंधनों और ितों का अनुपालन करता है।6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] परंतु चुनौती परीक्षण की प्रदक्रया िही होगी िो जिजनयम (11) के उप-जिजनयम (3) में उजल्लजखत ह।ै

(5) जचल् लर मॉडल के जलए प्राप्त जिकायत पर, ब्यूरो या नाजमत अजभकरण ऊिाा दक्षता ब् यूरो द्वारा ददए गए अनुमोदन की प्रामाजणकता सुजनजित करने के जलए जिजनमााता के पठरसर में परीक्षण ठरकॉडा का सत्यापन करेगी।

(6) यदद चेक परीक्षण के जलए चुना गया एक नमूना पहले चेक परीक्षण के दौरान जिफल हो िाता है, तो जनमाता ा को दसू रे चेक परीक्षण के जलए उसी मॉडल का अजतठरि नमूना पेि करने का एक और अिसर ददया िाएगा और दसू रे चेक परीक्षण के दौरान, यदद जचल् लर दफर से जिफल हो िाता ह,ै तो जनम्नजलजखत लागू होगा- (क) सभी राज्य अजभजहत अजभकरणों को सूचना के अधीन, प्ररूप 5 में अनुज्ञापत्रधारी को जनदेि देगा दक अनुज्ञापत्रधारी दो मास की अिजध के भीतर अनुज्ञापत्रधारी, -

(i) जचल् लर के लेबल पर संप्रदर्िात स्ट्टार स्ट्तर में सुधार करेगा या परीक्षण के दौरान पाई गई त्रुठटयों और कजमयों को दरू करेगा;

(ii) ब्यूरो के जनदेिों का पालन करने के जलए बािार से सभी स्ट्टॉक िापस लेगा; और

(iii) जिज्ञापन सामग्री पर संप्रदर्िात जिजिजियों में पठरितान करेगा। (ख) ऊिाा दक्षता ब् यूरो उपभोिाओं के लाभ के जलए, दकसी भी राष्ट्रीय या प्रादेजिक दैजनक समाचार पत्र में दकसी भी अनुज्ञापत्रधारी, ब्ांड नाम, मॉडल नाम या मॉडल नंबर, लोगो और अन्‍दय जिजनदेि का नाम और दकसी भी इलेक्रॉजनक या दकसी अन्‍दय रीजत से प्रकाजित करेगा, िो िह दो मास के भीतर िीक समझे;

(ग) ऊिाा दक्षता ब् यूरो जचल् लर मॉडल और संबद्ध बेजसक मॉडल ग्रुप की मंिूरी रद्द करेगा। (घ) ऊिाा दक्षता ब् यूरो संबंजधत राज्य अजभजहत अजभकरण को ऊिाा संरक्षण अजधजनयम की धारा 27 के अधीन अनुज्ञापत्रधारी और व् यापारी के जिरूद्ध न्‍द यायजनणायन कारािाई िुरू करने के जलए सूजचत करेगा। (ड.) जनमााता की घोषणा के अनुसार गरै -अनुपालन की जस्ट्थजत में, जनमााता को संबंजधत मूल मॉडल समूह के जलए प्रदिान के डी-रेटेड गुणांक या भारतीय आिताक ऊिाा दक्षता अनुपात के साथ दफर से एक नया आिेदन िमा करना होगा। ठटप्प ण : दकसी भी जिफलता के मामले में ब्यूरो का जनणाय जिजनयमन (11) के उप-जिजनयम (6) के खंड (क) से खंड (ड.) के अनुसार दकया िाएगा।

(7) अनुज्ञाधारी, जिजनयम 11 के उप-जिजनयम (6) में जिजनर्दाष् ट दो मास की अिजध की समाजप्त के दस ददनों के भीतर, जनदेि के अनुपालन में की गई कारािाई के संबंध में प्ररूप 6 में अनुपालन ठरपोटा ब्यूरो को भेिेगा।

(ख) जचल् लर के केिल ऐसे मॉडल पर लेबल जचपकाना जिसके जलए अनुज्ञा दी गई है; (ग) अनुज्ञापत्रधारी की लागत पर जचल् लर पर लेबल मुदरत दकया िाएगा; (घ) अनुज्ञापत्रधारी यह सुजनजित करता ह ैदक जचल् लर पर संप्रदर्िात स्ट्ट ार लेबल हर समय अनुरजक्षत रखा िाएगा;

(ड.) अनुज्ञापत्रधारी ब्यूरो द्वारा यथाजिजनर्दाष् ट लेबल फीस का संदाय करेगा ; (च) अनुज्ञापत्रधारी जित्तीय िषा की प्रत्येक जतमाही के अंत म ेंआगामी मास के भीतर प्रत्येक जतमाही के जलए लेबलीकृत उपस्ट्कर के उत्पादन के ब् यौरों का एक जििरण ब्यूरो को प्रस्ट्तुत करेगा। िही ब्यौरे ब्यूरो को एक स्ट्िचाजलत प्रणाली के माध्यम से भी प्रस्ट्तुत दकए िाएंगे;

(छ) अनुज्ञापत्रधारी जचल् लर के ऐसे अन्‍दय ब् यौरे उपलब्ध कराएगा िैसा और िब ब्यूरो चाहगे ा, जिसके जलए अनुज्ञा दी गई है।

3. अनुज्ञापत्रधारी, ब्यूरो के पूिाानुमोदन के जबना, अनुज्ञा की जिजधमान्‍द य अिजध के दौरान बािार से रजिस्ट् रीकृत ब्ांड और जचल् लर को िापस नहीं लेगा।

4. ब्ांड के जलए ऊिाा दक्षता ब् यूरो द्वारा समनुदेजित यूजनक लेबल श्रृंखला कोड ............ है और इसे अनुमोददत जडिाइन के अनुसरण में लेबल पर ददखाई देना चाजहए।

2. यह अनुज्ञा इस िता के अध्य धीन ह ैदक - (क) जचल् लर के लेबल पर संप्रदर्िात स्ट् टार लेबल अजधजनयम की धारा 14 के खंड (क) और पूिोि जिजनयमों में उपबंजधत दकए गए जनबंधनों और ितों के अधीन अजधसूजचत जचल् लर के जलए ऊिाा उपभोग मानक के अनुरूप होगा;

(ख) जचल् लर के केिल ऐसे मॉडल के लेबल पर मुहर लगाई िाएगी जिसके जलए अनुज्ञा दी गई है; (ग) अनुज्ञापत्रधारी की लागत पर जचल् लर पर लेबल को मुदरत या जचपकाया िाएगा; (घ) अनुज्ञापत्रधारी यह सुजनजित करेगा दक जचल् लर पर संप्रदर्िात स्ट्ट ार स्ट् तर सभी समय अनुरजक्षत रखा िाएगा;

(ड.) जचल् लर पर जचपकाए िाने िाले प्रत् येक लेबल के जलए अनुज्ञापत्रधारी प्रजत लेबल तीन रुपए प्रजत दकलोिॉट की लेबल फीस का संदाय करेगा; (च) अनुज्ञापत्रधारी जित्तीय िषा की प्रत्येक जतमाही के अंत म ेंआगामी मास के भीतर प्रत्येक जतमाही के जलए लेबलीकृत उपस्ट्कर के उत्पादन के ब् यौरों का एक जििरण ब्यूरो को प्रस्ट्तुत करेगा। िही ब्यौरे ब्यूरो को एक स्ट्िचाजलत प्रणाली के माध्यम से भी प्रस्ट्तुत दकए िाएंगे;

(छ) िही ब्यौरे एक स्ट्िचाजलत प्रणाली के माध्यम से ब्यूरो को प्रस्ट्तुत दकए िाएंगे; (ि) अनुज्ञापत्रधारी जचल् लर के ऐसे अन्‍दय ब् यौरे उपलब्ध कराएगा िैसा और िब ब् यूरो चाहगे ा, जिसके जलए अनुज्ञा दी गई है।

NOTIFICATION New Delhi, the 20th September, 2023 No. BEE/S&L/Chillers/40/2021-22.—Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Chillers) Regulations, 2022, were published vide notification number BEE/S&L/Chillers/40/2022-23 on dated 28th October, 2022, Extraordinary, Gazette of India, Part III,

Section 4 as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said notification in the Official Gazette;

And, whereas, Gazette copies of the said draft regulations were made available to the public on 28th October, 2022;

And, whereas, certain objections or suggestions have been received from the public with respect to the said draft regulations within the specified period aforesaid;

And, whereas, the suggestions received in this regard have been taken into consideration;

Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of

2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations,

namely:–

1. Short title and commencement. – (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Chillers) Regulations, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions. – (1) In these regulations, unless the context otherwise requires,–

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “Basic Model Group” means group of models that share characteristics which allow the performance of one model to be representative of the performance of other models within the group. Within a given range of cooling capacity, a Basic Model Group shall comprise of chiller models, lying in the same star level band with similar energy performance in terms of Indian Seasonal Energy Efficiency Ratio.

(c) “Child model” means shall have cooling capacity in kilowatt, less than that of the cooling capacity of the parent model in the same Basic Model Group.

(d) “Chillers” means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(e) “Form” means a form appended to these regulations;

(f) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the Chiller;

(g) “label period” means the validity period of the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, by the ending timeline of the label validity period, the new energy consumption standards under section 14 (a) of the Act is not notified, the existing standards shall deemed to be valid until new values for the same are notified by the Central Government;

(h) “Parent Model” means shall be a chiller model with highest cooling capacity in kilowatt, within the cooling capacity range of respective Basic Model Group.

(i) “permittee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(j) “Schedule” means the schedule annexed to these regulations;

(k) “star rating or star level” means the grade of energy efficiency displayed on the label of the chillers based on Indian Seasonal Energy Efficiency Ratio notified by the Central Government under clause (a) of

(l) “trader or seller” in relation to any chiller means a person who sells or distributes such chiller and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such chiller.

(2) Words and expressions used herein and not defined in the Act, shall have meanings assigned to them in the Act.

3. Particulars to be displayed on label. – (1) On every chiller, the following particulars shall be displayed on its label, namely:–

(a) the logo of the Bureau of Energy Efficiency;

(b) appliance or type;

(c) name of manufacturer or importer and brand;

(d) Basic Model Group or Model and year of manufacturing or import;

(e) unique series code;

(f) cooling technology;

(g) compressor type;

(h) cooling capacity;

(i) Indian Seasonal Energy Efficiency Ratio;

(j) total power input; and

(k) label period.

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels. – (1) Transition from Voluntary to Mandatory regime.- A label containing all the particulars specified in regulation 3 shall be displayed on every chiller within a period of six months from the date of coming into force of these regulations.

(2) Revision of Mandatory Energy Consumption Standards. – On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller,–

(a) shall not produce the chiller with the previous energy consumption standards;

(b) the chiller shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the chiller in synchronization with revised energy consumption standards; and

Provided that for smooth transition, manufacturer shall produce or import the product two months in advance from the date of such commencement with the revised energy performance standards;

(c) all preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken three months in advance.

5. Manner of display of label. – (1)There shall be a label on chiller which shall be displayed at the point of sale and such label shall be affixed on chiller in the following manner, namely:-

(a) The label shall be firmly fixed on chiller and near the nameplate of the chiller.

(b) The label shall be of durable material (aluminium anodized) and be printed as per the size given in the schedule attached to this regulation.

(2) The name plate of corrosion resistant material shall be affixed on the chiller. The markings required by the schedule shall be legible, indelible and durable.

6. Permission for display of label. – (1) No star label shall be affixed on a chiller without obtaining the prior permission of the Bureau.

(2) Company Registration. – For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I (A), accompanied by a label security fee of one lakh rupees, payable by

any acceptable electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only;30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(3) Model Registration. – Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by any other acceptable electronic mode of payment; and

(b) documents specified in Form I (B).

7. Grant of permission. – (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in Disseminating Star Labeling in Household Appliance (Bureau’s Operation Manual on Standards and Labelling) from the date of such receipt, grant, subject to such terms and conditions as are specified in regulation 8,–

(a) register the brand in Form II (A) or in electronic form; and

(b) grant permission for affixing label on chiller in Form II (B) or in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein.

(3) The permission so granted under sub - regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 of the Act.

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

Provided, in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II (B).

(6) No application shall be renewed after expiry of validity period; in which case the permittee shall make a fresh application.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the chiller from the date from which the revised star level comes into force shall submit a declaration according to Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the chiller is planned to be launched synchronising with the revised star level, and application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label. – Every permittee, trader and seller shall,-

(a) comply with the energy consumption standards for chiller notified under clause (a) of section 14 of the Act;

(b) affix label only on such model of chiller for which permission has been granted;

(c) affix label on the chiller at the cost of the permittee;

(d) ensure that the star level displayed on the label of chiller shall be maintained at all time;

(e) pay the label fee as specified in regulation 9;

(f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of closure of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year; and

(h) comply with such other terms and conditions which the Bureau may specify including those contained in Disseminating Star Labeling in Household Appliance (Bureau’s Operation Manual on Standards and Labelling).

9. Label fee. – (1) Every permittee shall pay to the Bureau a label fee of rupees three per kilowatt for each label being affixed on chiller;

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of

Provided that on failure to pay the label fee within the period so specified, the Bureau shall recover the amount due with interest thereon at ten per cent. per annum from the label security deposit paid under clause (b) of sub-regulation (3) of regulation 6 and if complete labelling fees are not recovered within one year of the last date of submission and the Bureau shall cancel the labels granted to the permittee and publish his name in the national or regional daily newspapers and in electronic means as a defaulter.

10. Refund of label security deposit. – Subject to the provisions of sub-regulation (2) of regulation 9, the permittee shall be entitled to a refund of the label security deposit, on ceasing to manufacture chiller.

11. Verification by Bureau. – (1) The chiller manufacturer shall submit the chiller production schedule and delivery schedule about the chillers which are registered under star rating program, quarterly in online Bureau of Energy Efficiency portal.

(2) The check testing of chillers shall be conducted either in manufacturer’s test lab duly accredited by National Accreditation Board for Testing and Calibration Laboratories or in a third party or independent test laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories or any other accreditation bodies having Mutual Recognition Arrangements with Asia Pacific Accreditation Co-operation or International Laboratory Accreditation Co-operation.

(3) The check testing for chillers shall be conducted at independent test laboratory or in-house manufacturer’s test laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories in presence of the representative of Bureau of Energy Efficiency.

(4) The Bureau or its designated agency may, either suo motu or on a complaint received by it, carry out verification testing to ensure that the chiller conforms to the star level and other particulars displayed on its

label and that it complies with the other terms and conditions of permission:

Provided the procedure for challenge testing shall be same as mentioned in sub-regulation (3) of regulation (11).

(5) Where, upon a complaint received for a chiller model, the Bureau or designated agency would verify the test records at manufacturer’s premises to ensure the authenticity of the approval granted by Bureau of Energy Efficiency.

(6) Where if one sample selected for check testing fails during first check test, manufacturer shall be given another chance to offer additional sample of same model for second check test and during second check testing, if the chiller again fails, following shall apply.–

(a) direct the permittee in Form V, under intimation to all the State designated agencies, that the permittee within a period of two months shall, –

(i) correct the star level displayed on the label of the chiller or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

(b) Bureau of Energy Efficiency shall publish, for the benefit of the stakeholders, the name of the permittee, brand name, model name or model number, logo and other specific action in any national or regional daily newspaper and in any electronic or in other manner as it deems fit within two months;

(c) Bureau of Energy Efficiency shall cancel the approval of chiller model and associated basic model group.

(d) Bureau of Energy Efficiency shall intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Energy Conservation Act.

(e) In case of non-compliance as per manufacturer’s declaration, the manufacturer has to again submit a fresh application with de-rated Coefficient of Performance or Indian Seasonal Energy Efficiency Ratio for the respective basic model group.

Note: The decision of the Bureau in case of any failure shall be made in accordance with clause (a) to clause

(e) of sub-regulation (6) of regulation (11).32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(7) The permittee shall, within ten days of the conclusion of the period of two months referred to in sub-regulation (6) of regulation 11 send the compliance report in Form VI to the Bureau with respect to action taken in compliance with the direction.

12. Cancellation of permission. – The Bureau may cancel the permission granted under regulation 7, if the permittee,

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) fails to comply with the directions issued under regulation 11.

Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Chillers) Regulations, 2023 you were permitted to affix label on the Chillers vide Bureau of Energy Efficiency letter No. ..............dated....... subject to the compliance of the terms and conditions specified therein.

2. The results of the test report on the sample bearing unique identification serial number is enclosed. Verification testing of the chiller model indicated that the sampled Chiller failed to meet the energy performance norms (Cooling Capacity, Power Consumption, Indian Seasonal Energy Efficiency Ratio) and did not conform to the test details furnished by you in Form I annexed to the application submitted by you for seeking permission to affix label on the Chiller manufactured/imported by you. The verification results were sent to you vide the Bureau letter No........dated........in the name of your authorized contact person.

3. The test results of check testing are enclosed which are duly checked and counter signed by the competent authorized personnel of the National Accreditation Board for Testing and Calibration Laboratories accredited laboratory. The test report is also duly signed by your authorized signatory as witness of check testing activity. The test results conforms that they failed to meet the requisite parameters and standards given in S.O. number.…dated, ….and the terms and conditions of the permission given to you for display of particulars on label affixed to the Chillers manufactured/imported and sold in the market .

4. The Bureau hereby directs you to correct the star level displayed on the label of the chillers or remove the defects and deficiencies found during testing; withdraw all the stocks from the market to comply with the directions of the Bureau; and change the particulars displayed on advertising material.

5. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within ten days after the expiry of two months, i.e., by ...............In case no compliance report is received by the said date, the Bureau shall proceed to take action under these regulations.

6. The Bureau shall take further follow up action in accordance with the provisions of these regulations.
