और उय प्रारूप जवजनयम की प्रजतयां जनता को 24 अगस्ट्त , 2022 को उपलब्ध करा दी गई थीं; और पूवोय अवजध के भीतर उय प्रारूप जवजनयम के बाबत सझझाव प्राप्त हुए ह;ैं और इस संबंध म ेंप्राप्त सझझाव पर जवचार कर जलया गया ह;ै अत:, अब, ब्यूरो, केन्‍द रीय सरकार के पूवा अनझमोदन से ऊजाा संरक्षण अजधजनयम, 2001 (2001 का 52) की धारा 13 की उपधारा (2) के खंड (ढ) और धारा 14 के खडं (घ) के साथ पठठत धारा 58 की उपधारा (2) के खंड (झ) द्वारा प्रदत्त िजयय का प्रयोग करते हुए, जनम्नजलजखत जवजनयम बनाता ह,ै अथाात्:-

1. संजक्षप्त नाम और प्रारंभ :- (1) इन जवजनयम का संजक्षप् त नाम ऊजाा दक्षता ब् यूरो (हल् के वाजणजकयक एयर कंडीिनर के लेबल पर उनके संप्रदिान की जवजिजियां और रीजत) जवजनयम, 2023 ह।ै

(2) ये जवजनयम राजपत्र में इनके प्रकािन की तारीख स े प्रवृत् त ह गे। 1276 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

2. पठरभाषाएं.- (1) इन जवजनयम में, जब तक संदभ ामें अन्‍दयथा अपेजक्षत न हो,- (क) “अजधजनयम“ से ऊजाा सरं क्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ह;ै (ख) “प्ररूप“ से इन जवजनयम के साथ संलग्न कोई प्ररूप अजभप्रेत है;

(ग) “लेबल“ से दकसी भी जलजखत, मझदरत, जचजननत, मझरांदकत या लेखाजचत्रीय पदाथा अजभप्रेत ह ै जो हल् के वाजणजकयक एयर कंडीिनर पर जचपकाया गया ह ैया उस पर ददखाई द ेरहा ह;ै (घ) "हल् के वाजणजकयक एयर कंडीिनर" स े अजभप्रते अजधजनयम की धारा 14 के खंड (ख) के अधीन अजधसूचना म ें जवजनर्ददष् ट रूम एयर कंडीिनर ह।ै इसम ें 10॰5 दकलोवाट स े ऊपर और 18॰0 दकलोवाट तक रेटेड क्षमता वाल े हल्के वाजणजकयक एयर कंडीिनर सजममजलत ह;ैं (ड.) “लेबल अवजध“ से अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत जवत उझत उपभोग मानक की जवजधमान्‍द यता अवजध अजभप्रेत ह ै परंत,झ यदद लेबल जवजधमान्‍द यता अवजध की समाजप्त की समय-सीमा तक, अजधजनयम की धारा 14 (क) के अधीन नए ऊजाा उपभोग मानक को अजधसूजचत नहीं दकया जाता ह,ै जवत उमान मानक को तब तक जवजधमान्‍द य समझा जाएगा जब तक दक केन्‍द रीय सरकार द्वारा इसके जलए नए मान अजधसूजचत नहीं दकए जाते;

(च) “अनझज्ञापत्रधारी“ से एक व्यजय या अजभकरण अजभप्रेत ह ै जजसे जवजनयम 7 के अधीन लबे ल जचपकान े की अनझज्ञा दी गई ह;ै (छ) “अनझसूची“ से इन जवजनयम से उपाबद्ध अनझसूची अजभप्रेत ह;ै (ज) “स्ट्टार रेटटग या स्ट् टार स्ट् तर“ से अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत जवत उझत उपभोग मानक के कधार पर हल् के वाजणजकयक एयर कंडीिनर के लेबल पर संप्रदशितित ऊजा ा दक्षता की रेणी अजभप्रेत ह;ै (झ) दकसी हल् के वाजणजकयक एयर कंडीिनर के सबं धं म ें “व्यापारी या जवक्रेता“ स े एक ऐसा व्यजय अजभप्रते ह ैजो ऐस े हल्क े वाजणजकयक एयर कंडीिनर को बेचता या जवतठरत करता ह ै और इसम ें दकझ ानदार, व्यापारी, जवजनमााता और अनझज्ञापत्रधारी सजममजलत ह ैंजजन्‍दह ेंऐसे एयर कंडीिनर पर लेबल जचपकान े की अनज्ञझ ा दी गई ह।ै

(2) उन िब् द और पद के, जो इसम ें प्रयझक् त ह ैं और पठरभाजषत नहीं ह,ैं दकन्‍द तझ अजधजनयम म ें पठरभाजषत ह,ैं वही अथ ा ह ग े जो अजधजनयम म ेंह।ैं

3. लबे ल पर सप्रं दशितित की जान े वाली जवजिजियां - (1) प्रत्येक हल् के वाजणजकयक एयर कंडीिनर पर, जनम्नजलजखत जवजिजियााँ उसके लेबल पर संप्रदशितित की जाएगं ी, अथाात् - (क) स्ट् टार स्ट् तर; (ख) भारतीय कवताक ऊजाा दक्षता अनझपात;

(ग) लेबल जवजधमान्‍द यता की अवजध; (घ) एयर कंडीिनर के साजधत्र या प्रकार; (ङ) जवजनमााता या कयातकताा का नाम और ब्ांड; (च) मॉडल तथा जवजवजनमााण या कयात का वषा; (छ) िीतलन क्षमता (ित प्रजतित) वाट म;ें (ज) िीतलन क्षमता (पचास प्रजतित) वाट म;ें (झ) ऊजाा उपभोग यूजनट प्रजत वषा में;

(ञ) संपीड़क प्रकार; (ट) ऊजाा दक्षता ब्यरू ो का लोगो; (ठ) साजधत्र का नाम और[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 3 (ड) यूजनक रृंखला कोड;

(2) लेबल का जडज़ाइन, रंग, ककार और जवषय-वस्ट् तझ इन जवजनयम से उपाबद्ध अनझसूची म ेंजवजनर्ददष् ट होगी।

4. लबे ल सप्रं दशितित करन ेकी समय सीमा

(1) स्ट् वजै कछक स े अजनवाया व् यवस्ट् था तक पारगमन - जवजनयम 3 में जवजनर्ददष् ट सभी जवजिजिय वाला एक लेबल इन जवजनबंधन के प्रवृत् त होने की तारीख से छह मास की अवजध के भीतर प्रत्येक हल् के वाजणजकयक एयर कंडीिनर पर संप्रदशितित दकया जाएगा।

(2) अजनवाय ा ऊजा ा उपभोग मानक का पनझ रीक्षण.- अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत पझनरीजक्षत जवत उझत उपभोग मानक के प्रारंभ होन े पर, प्रत्येक अनझज्ञापत्रधारी या व्यापारी या जवक्रेता- (क) जपछले ऊजाा उपभोग मानक वाले हल् के वाजणजकयक एयर कंडीिनर का उत्पादन नहीं करेगा;

(ख) पझनरीजक्षत ऊजाा उपभोग मानक के साथ तल्झ यकालन करते हुए पनझ रीजक्षत ऊजाा उपभोग मानक के साथ ऊलत ा स्ट्टार स्ट्तर और लेबल अवजध और हल्क े वाजणजकयक एयर कंडीिनर का जवजवजनमााण वषा प्रदशितित दकया जाएगा; (ग) व् यवहाठरय , खझदरा जवक्रेताओं की जागरूकता, उनकी जिक्षा के साथ-साथ उपभोयाओं की जिक्षा के जलए अपेजक्षत प्रचार सजहत प्रारंजभक कदम सझजनयोजजत ह और कारावाई तीन मास पहले की जाए।

5. लबे ल सप्रं दशितित करन े की रीजत - (1) प्रत्येक जवजनमााता, जवक्रेता या व्यापारी प्रत्येक हल्क े वाजणजकयक एयर कंडीिनर पर जवक्रय के समय फ्रंट पैनल पर दोन तरफ एक लेबल संप्रदशितित करेगा और ऐसा लेबल उस पर संप्रदिा फ्रंट पर स्स्ट्वग टैग के रूप में चस्ट् पा या सलं ग्न दकया जाएगा।

(2) जो यूजनटें संप्रदिान नहीं कर रही ह,ैं वहााँ लेबल को हल् के वाजणजकयक एयर कंडीिनर के कवरण के बाहरी भाग पर संलग्न दकया जा सकेगा और लबे ल को यूजनट में तभी संलग्न दकया जा सकेगा जब उसकी पैकेस्जग से यूजनट को हटा ददया गया हो या लेबल को उपभोया या उपयोक्त ा को ददए गए प्रलखे (दस्ट्तावेज ) के भाग के रूप में सजममजलत दकया गया हो।

6. लबे ल सप्रं दशितित करन े की अनज्ञझ ा - (1) ब्यूरो की पूवा अनझज्ञा प्राप्त दकए जबना दकसी हल् के वाजणजकयक एयर कंडीिनर पर कोई स्ट्टार लेबल नहीं लगाया जाएगा।

(2) कंपनी रजजस्ट्र ीकरण: - ब्यरू ो की अनझज्ञा प्राप्त करन े के प्रयोजन के जलए, प्रत्येक ब्ांड प्ररूप 1 - (क) म ें यथाजनर्ददष् ट पृ थक रूप स े रजजस्ट् रीकृत दकया जाएगा, जजसमें एक लाख रुपए का लेबल प्रजतभूजत फीस होगा, जो संदाय के दकसी भी स्ट्वीकाया इलेक्रॉजनक मोड द्वारा देय होगा परन्‍दत झलघझ उत उोग के मामले म ेंलेबल प्रजतभूजत फीस केवल पच्चीस हजार रुपए होगा।

(3) मॉडल रजजस्ट्र ीकरण - उपजवजनयम (2) के अधीन अनज्ञझ ा के प्रत्येक कवेदन के साथ-साथ जनम्नजलजखत ह ग े- (क) प्रजत मॉडल दो हजार रुपए की कवेदन फीस, जो संदाय के दकसी भी स्ट्वीकाया इलेक्रॉजनक मोड द्वारा देय ह;ै और ;

तथा (ख) प्ररूप 1 - (ख) में जवजनर्ददष् ट दस्ट्तावेज।

7. अनज्ञझ ा प्रदान करना -(1) जवजनयम 6 के अधीन एक कवदे न प्राप्त होन े पर और समाधान होन े के पश् चात ् दक सभी अप क्षे ाओं का अनझपालन दकया गया है, ब्यूरो मानक और लेबस्लग पर अपने मैनअझ ल में यथाजनर्ददष् ट अवजध के भीतर, जवजनयम 8 में यथाजनर्ददष् ट ऐसे जनबंधन और ितों के अधीन हो सकेगा जो- (क) ब्ांड को प्ररूप 2-(क) या इलेक्रॉजनक रूप म ेंरजजस्ट् रीकृत करें; तथा (ख) प्ररूप 2-(ख) या इलेक्रॉजनक रूप में हल् के वाजणजकयक एयर कंडीिनर पर लेबल लगान े की अनझज्ञा प्रदान करना।

(2) ब्यूरो प्ररूप 3 में जवजनर्ददष् ट एक रजजस्ट्टर बनायगे ा और उसमें अनझज्ञापत्रधारी का नाम दजा करेगा।

(3) उपजवजनयम (1) के अधीन दी गई अनझज्ञा उस अवजध के जलए जवजधमान्‍द य होगी, जजसके जलए धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत ऊजाा उपभोग मानक द्वारा जवजनर्ददष् ट स्ट्टार स्ट्तर लागू ह।ै4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(4) स्ट्टार रेटटग योजना के पझनरीक्षण के मामले में, अनझज्ञा के नवीनीकरण के जलए कवेदन अनज्ञझ ापत्रधारी द्वारा एक मास के जलए दकया जाएगा दकेंतझ इसकी समाजप्त के पहले नहीं दकया जाएगा और ऊजाा दक्षता ब्यूरो, नई ददल्ली के पक्ष म ें इलेक्रॉजनक मोड में एक हजार रुपए की फीस के साथ देय होगा। परंत,झ स्ट्टार रेटटग योजना के जवस्ट्तार के मामल े में, एक हजार रुपए की उय नवीनीकरण फीस से छूट दी जाएगी।

(5) उपजवजनयम (4) के अधीन नवीनीकरण के जलए कवेदन प्राप्त होने पर और समाधान होन े के पश् चात ् दक सभी अपेक्षाओं का अनझपालन दकया जाता ह,ै ब्यूरो, ऐसी प्राजप्त की तारीख से एक मास की अवजध के भीतर, प्ररूप 2 - (ख) म ें अनज्ञझ ा का नवीनीकरण कर सकेगा।

(6) जवजधमान्‍द यता अवजध की समाजप्त के पश् चात् दकसी भी कवेदन का नवीनीकरण नहीं दकया जाएगा, ऐसी जस्ट्थजत में अनझज्ञापत्रधारी को नया कवेदन करना होगा।

(7) ऐसा अनझज्ञापत्रधारी जो उस तारीख स े हल् के वाजणजकयक एयर कंडीिनर के जवत उमान मॉडल पर लेबल जचपकाने के जलए अनझज्ञा चाहता ह,ै जजस तारीख से पझनरीजक्षत स्ट्टार स्ट्तर प्रवृत् त होता ह,ै वह प्ररूप 4

(8) अनझज्ञापत्रधारी नए जसरे स ेलेबल लगान े के जलए अनझज्ञा लने े का प्रयास करेगा, यदद हल् के वाजणजकयक एयर कंडीिनर के नए मॉडल पझनरीजक्षत स्ट्टार स्ट्तर के साथ तल्झ यकालन दकया जाना ह,ै और ऐसी अनज्ञझ ा के जलए कवेदन पनझ रीजक्षत स्ट्टार स्ट्तर के प्रवृत् त होने के छह मास पहले दकया जाएगा।

8. लेबल पर जवजिजिय को संप्रदशितित करन े के जलए जनबंधन और ितें:- प्रत्येक अनझज्ञापत्रधारी, जवक्रेता या व्यापारी लेबल पर जवजिजियां संप्रदशितित करने में जनम्नजलजखत जनबंधन और ितों का पालन करेगा, अथाात् - (क) हल् के वाजणजकयक एयर कंडीिनर के लेबल पर संप्रदशितित स्ट् टार लेबल अजधजनयम की धारा 14 के खंड (क) के अधीन अजधसूजचत ऊजा ाउपभोग मानक के अनरूझ प होगा;

(ख) लेबल केवल हल् के वाजणजकयक एयर कंडीिनर के ऐसे मॉडल पर जचपकाया जाएगा जजसके जलए अनझज्ञा की मंजूरी दी गई ह;ै (ग) अनझज्ञापत्रधारी अपनी लागत पर लेबल को मझदरत करेगा और हल् के वाजणजकयक एयर कंडीिनर पर जचपकाएगा;

(घ) हल् के वाजणजकयक एयर कंडीिनर के लेबल पर संप्रदशितित स्ट्ट ार लेबल सभी समय अनरझ जक्षत रखा जाएगा; (ड) जवजनयम में यथाजवजनर्ददष् ट लेबल फीस का संदाय करेगा; (च) लेबलीकृत उपस्ट्कर के उत्पादन के ब्यौर से अंतशितवि जवजिजियां और जवत्तीय वषा की प्रत्येक जतमाही के कगामी समापन मास के भीतर प्रत्येक जतमाही के जलए देय उद्भूत फीस ब्यूरो को प्रस्ट्तझत की जाएगी;

(छ) प्रत्येक वषा अप्रलै मास के 30वें ददन तक अपने लेबल वाले उत्पाद के जवक्रय के जलए जनयझय प्राजधकृत जवतरक , व् यवहाठरय , खझदरा जवक्रेताओं और जवक्रेताओं की एक अत उतन सूची ब्यूरो को प्रस्ट्तझत की जाएगी; और (ज) ऐसे अन्‍दय जनबंधन और ितों का अनझपालन दकया जाएगा जजन्‍दह ें ब्यूरो मानक और लेबस्लग पर ब्यूरो के प्रचालन मैनझअल म ेंजनजहत जनबंधन सजहत जवशितनददि करेगा।

9. लबे ल फीस: - (1) प्रत्येक अनझज्ञापत्रधारी ब्यरू ो को हल् के वाजणजकयक एयर कंडीिनर पर इस प्रकार जचपकाए गए लेबल पर तीस रुपए की लेबल फीस का संदाय करेगा।

(2) उपजवजनयम (1) के अधीन जवजनर्ददष् ट लेबल फीस प्रत्यके जवत्तीय वषा की अंजतम तारीख से एक मास के भीतर वाशितषक रूप से संदाय की जाएगी परन्‍दत झ इस प्रकार जवजनर्ददष् ट अवजध के भीतर लेबल फीस का संदाय करन े में असफल रहन े पर जवजनयम 6 के उपजवजनयम

(2) के अधीन ब्यूरो लेबल प्रजतभूजत फीस स े उस पर दस प्रजतित की दर से ब्याज सजहत संदत्त िोध रकम वसूल कर सकेगा और यदद संदाय की अंजतम तारीख के एक वषा के भीतर लेबस्लग फीस की कझल रकम की वसूली नहीं की जाती है, तो ब्यूरो अनझज्ञापत्रधारी को ददए गए सभी लेबल को रद्द कर सकेगा और समाचार पत्र में व् यजतक्रम के रूप म ें अनझज्ञापत्रधारी का नाम प्रकाजित कर सकेगा।

10. लबे ल प्रजतभजू त फीस का प्रजतदाय - जवजनयम 9 के उपजवजनयम (2) के परंतकझ के अधीन, अनज्ञझ ापत्रधारी हल्क े वाजणजकयक एयर कंडीिनर का जवजनमााण बंद करन े पर लेबल प्रजतभूजत फीस के संदाय का हकदार होगा।[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 5

11. ब्यरू ो द्वारा सत्यापन - (1) ब्यूरो स्ट्वप्ररे णा स े या प्राप्त जिकायत पर यह सझजनजित करने के जलए सत्यापन करेगा दक हल् के वाजणजकयक एयर कंडीिनर स्ट् टार स्ट् तर और उसके लेबल पर संप्रदशितित अन्‍दय जवजिजिय के अनरूझ प और दक अनझज्ञा के अन्‍दय जनबंधन और ितों का अनझपालन करता ह।ै जवत उझत उपभोग, क्षमता परीक्षण, जवत उझत कारक और अजधकतम प्रचालन जस्ट्थजत परीक्षण सजहत सभी परीक्षण ब्यरू ो द्वारा या इसके अजभजहत अजभकरण के माध्यम से सत्यापन और चझनौती परीक्षण के प्रयोजन स ेएन्‍दथेल्पी पद्धजत या कैलोरीमीटर का उपयोग करके कयोजजत दकए जाएंगे।

(2) सत्यापन के प्रयोजन के जलए, नमूने को ब्यूरो या इसके अजभजहत अजभकरण द्वारा जवजवजनमााण सझजवधा, गोदाम या खझदरा कउटलेट स ेयादजृ कछक रूप से उठाया जाएगा जो वह ठीक समझे।

(3) जहााँ, उपजवजनयम (1) के अधीन प्राप्त की गयी जिकायत पर, ब्यूरो को परीक्षण और अंिांकन प्रयोगिालाओं के जलए राष्ट्रीय प्रत्यायन बोड ा द्वारा सम यक रूप स े प्रत् याजयत स्ट्वतंत्र प्रयोगिाला म ें हल् के वाजणजकयक एयर कंडीिनर का परीक्षण करके सत्यापन करना अपेजक्षत ह ै और वहााँ ऐस े परीक्षण करन े के जलए प्ररूप 5 में अनझज्ञापत्रधारी को एक सूचना जारी की जाएगी और जिकायतकताा को ब् यूरो के पास नमूना लागत, परीक्षण, पठरवहन और अन्‍दय कनझषंजगक व्यय स े संबंजधत जो ब्यरू ो द्वारा अजिम म ें अवधाठरत दकय े जाएं, ऐसे व् यय को ब्यूरो के पास जमा करन े के जलए कहा जाएगा।

(4) यदद चझनौती परीक्षण के अधीन जलया गया नमूना असफल हो जाता ह,ै तो यथाजवजनर्ददष् ट सभी व् यय की प्रजतपूशितत अनझज्ञापत्रधारी द्वारा ब्यूरो को की जाएगी और ब्यरू ो जिकायतकताा को उपरोय व् यय वापस कर दगे ा; और जहााँ उपस्ट् कर चझनौती परीक्षण पास करता ह,ै तो जिकायतकताा द्वारा जमा दकए गए व् यय को समपृतत कर जलया जाएगा।

(5) जहााँ परीक्षण के जलए उपयोग दकए जाने वाले हल् के वाजणजकयक एयर कंडीिनर का एक नमूना स्ट्वत परीक्षण या चझनौती परीक्षण के दौरान परीक्षण में असफल रहता ह,ै ब्यूरो अनझज्ञापत्रधारी को एक और अवसर प्रदान करेगा और पहल े परीक्षण म ें उपयोग दकए गए हल् के वाजणजकयक एयर कंडीिनर की दोगनझ ी मात्रा के साथ दसू रा परीक्षण को संचाजलत करेगा। यह जांच-परीक्षण, एक स्ट्वतंत्र परीक्षण प्रयोगिाला म ें होगा, जो उस प्रयोगिाला से अलग होगा जहा ाँ पहला जााँच परीक्षण दकया गया था और अनझज्ञापत्रधारी की लागत पर परीक्षण और अिं ांकन प्रयोगिालाओं के जलए राष्ट्रीय प्रत्यायन बोडा द्वारा सम यक रूप से प्रत् याजयत होगा।

(6) ब्यूरो उपजवजनयम (3) में जनर्ददष् ट चझनौती परीक्षण या उपजवजनयम (4) में जनर्ददष् ट दसू रे परीक्षण और नमनू े की खरीद और परीक्षण के जलए दकए जाने वाल ेव् यय को देखने के जलए प्ररूप 5 में अनझज्ञापत्रधारी को सूजचत करेगा।

(7) जहााँ पर, अनझज्ञापत्रधारी ऐसे व् यय करने म ेंअसफल रहता ह,ै वहां ब्यूरो - (क) उपजवजनयम (3) में जनर्ददष् ट चझनौती परीक्षण या उपजवजनयम (4) में जनर्ददष् ट दसू रे परीक्षण द्वारा सत्यापन जारी रखेगा; (ख) जवजनयम 6 के अधीन प्राप्त कवेदन की कगे की प्रदक्रया को रोकेगा;

(ग) प्ररूप 5 के जारी होने की तारीख से छह मास के पश् चात,् जवजनयम 7 के अधीन अनज्ञझ ापत्रधारी को ददए गए सभी लेबल रद्द कर देगा।

(8) जहााँ पर दसू रा परीक्षण असफल हो जाता ह,ै ब्यूरो - (क) सभी राकय अजभजहत अजभकरण को सूचना के अधीन प्ररूप 6 में अनझज्ञापत्रधारी को जनदिे देगा दक दो मास की अवजध के भीतर अनझज्ञापत्र धारी -

(i) हल् के वाजणजकयक एयर कंडीिनर के लेबल पर संप्रदशितित स्ट्ट ार लेबल म ें सझधार करेगा या परीक्षण के दौरान पाई गई त्रझठटय और कजमय को दरू करेगा;

(ii) ब्यूरो के जनदिे का पालन करने के जलए बाजार से सभी स्ट्टॉक वापस लेगा; और

(iii) जवज्ञापन सामिी पर संप्रदशितित जवजिजिय म ेंपठरवतान करेगा। (ख) उपभोयाओं के लाभ के जलए, दकसी भी राष्ट्रीय या प्रादेजिक दैजनक समाचार पत्र में दकसी भी अनझज्ञापत्रधारी, ब्ांड नाम, मॉडल नाम या मॉडल नंबर, लोगो और अन्‍दय जवजनदेि का नाम और दकसी भी इलक्े रॉजनक या दकसी अन्‍दय रीजत से प्रकाजित करेगा, जो वह दो मास के भीतर ठीक समझे;6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ग) संबंजधत राकय अजभजहत अजभकरण को अजधजनयम की धारा 27 के अधीन अनझज्ञापत्रधारी और व्यापारी के जवरूद्ध न्‍द यायजनणायन कायावाही िझरू करन े के जलए सूजचत करेगा।

(9) अनझज्ञापत्रधारी, उपजवजनयम (7) में जवजनर्ददष् ट दो मास की अवजध के समापन के दस ददन के भीतर, जनदेि के अनझपालन म ेंकी गई कारावाई के बाबत प्ररूप 7 में अनझपालन ठरपोटा ब्यूरो को भेजगे ा।

(10) यदद उपजवजनयम (8) में जवजनर्ददष् ट अनझपालन ठरपोट ा जवजनर्ददष् ट अवजध के भीतर दकसी भी जनदेि का पालन दकए जबना प्राप्त या प्राप्त नहीं की जाती है, तो यह समझा जाएगा दक जारी दकए गए जनदेि का अनझपालन नहीं दकया गया ह ैऔर ब्यरू ो उस प्रभाव का कदेि दगे ा।

(11) ब्यूरो उपजवजनयम (8) में जवजनर्ददष् ट अनपझ ालन ठरपोटा और उपजवजनयम (9) में पाठरत कदेि को धारा 17 के अधीन कारावाई करन े और उपजवजनयम (9) के अधीन पाठरत कदेि के प्रवतान के प्रयोजन के जलए सभी राकय अजभजहत अजभकरण को भेजेगा।

(12) जहााँ पर अनझज्ञापत्रधारी उपजवजनयम (7) के अधीन ब्यूरो द्वारा जारी जनदेि का पालन करने में असफल रहता है, ब्यूरो करेगा, - (क) जवजनयम 7 के उपजवजनयम (1) के अधीन अनझज्ञापत्रधारी को दी गई अनझज्ञा को वापस लगे ा;

(ख) धारा 14 के खंड (क) के अधीन केन्‍द रीय सरकार द्वारा अजधसूजचत ऊजाा उपभोग मानक के अनरूझ प अनझज्ञापत्रधारी द्वारा असफलता के समथान में परीक्षण ठरपोटा के साथ ब्यूरो द्वारा जारी कदेि खंड (क) के अधीन जवचार के जलए और धारा 14 के खंड (ग) के अधीन केन्‍दर ीय सरकार द्वारा कारावाई करन े के जलए केन्‍द रीय सरकार को एक ठरपोटा भेजेगा;

(ग) उपभोयाओं के फायद े के जलए, दकसी भी राष्ट्रीय या प्रादेजिक दैजनक समाचार पत्र म ें और दकसी भी इलेक्रॉजनक या दकसी अन्‍दय रीजत से दकसी भी अनझज्ञापत्रधारी के नाम, ब्ांड नाम, मॉडल नाम या मॉडल नंबर, लोगो और अन्‍दय जवजनदेि प्रकाजित करेगा जो वह दो मास के भीतर ठीक समझे; और (घ) संबंजधत राकय अजभजहत अजभकरण को अजधजनयम की धारा 27 के अधीन अनझज्ञापत्रधारी और व्यापारी के जवरूद्ध कगे की न्‍द यायजनणायन कायावाही िझरू करन े के जलए सूजचत करेगा।

12. अनज्ञझ ा का रद्दकरण:-ब्यरू ो जवजनयम 7 के अधीन दी गई मंजूर की गयी अनज्ञझ ा को रद्द कर सकता है, यदद अनज्ञझ ापत्रधारी- (क) जवजनयम 8 के अधीन जवजनर्ददष् ट दकसी भी जनबंधन और ितों का अनझपालन करने म ेंअसफल रहता ह;ै (ख) जवजनयम 9 के अधीन जवजनर्ददष् ट अवजध के भीतर लेबल फीस का संदाय करन ेमें असफल रहता है;

1. ब्यूरो कपको इस पत्र के उपाबंध में ददए गए अनझमोदन के ब् यौरे के अनझसरण म ें अपने ब्ांड को रजजस्ट् टर करन े की अनझज्ञा दते ा ह।ै

2. यह अनज्ञझ ा जनम्नजलजखत के अधीन ह-ै (क) हल् के वाजणजकयक एयर कंडीिनर के लेबल पर संप्रदशितित स्ट् टार स्ट्त र अजधजनयम की धारा 14 के खडं (क) और पूवोय जवजनबंधन में उपबंजधत जनबंधन और ितों के अधीन अजधसूजचत हल् के वाजणजकयक एयर कंडीिनर के जलए ऊजाा उपभोग मानक के अनझरूप होगा;

(ख) हल् के वाजणजकयक एयर कंडीिनर के केवल ऐसे मॉडल पर लेबल जचपकाना जजसके जलए अनझज्ञा दी गई है; (ग) अनझज्ञापत्रधारी की लागत पर हल् के वाजणजकयक एयर कंडीिनर पर लेबल मझदरत दकया जाएगा; (घ) अनझज्ञापत्रधारी यह सझजनजित करता ह ै दक हल् के वाजणजकयक एयर कंडीिनर पर संप्रदशितित स्ट् टार लेबल हर समय अनझरजक्षत रखा जाएगा;

(ड.) अनझज्ञापत्रधारी ब्यूरो द्वारा यथाजवजनर्ददष् ट लेबल फीस का संदाय करेगा ; (च) अनझज्ञापत्रधारी जवत्तीय वषा की प्रत्येक जतमाही के अंत में कगामी मास के भीतर प्रत्येक जतमाही के जलए लेबलीकृत उपस्ट्कर के उत्पादन के ब् यौर का एक जववरण ब्यरू ो को प्रस्ट्ततझ करेगा। वही ब्यौरे ब्यरू ो को एक स्ट्वचाजलत प्रणाली के माध्यम से भी प्रस्ट्ततझ दकए जाएंगे;

(छ) अनझज्ञापत्रधारी हल् के वाजणजकयक एयर कंडीिनर के ऐसे अन्‍दय ब् यौरे उपलब्ध कराएगा जसै ा और जब ब्यरू ो चाहगे ा, जजसके जलए अनझज्ञा दी गई ह।ै

3. अनझज्ञापत्रधारी, ब्यूरो के पूवाानमझ ोदन के जबना, अनझज्ञा की जवजधमान्‍द य अवजध के दौरान बाजार स े रजजस्ट् रीकृत ब्ांड और हल् के वाजणजकयक एयर कंडीिनर को वापस नहीं लेगा।

2. यह अनज्ञझ ा इस िता के अध् यधीन ह ैदक - (क) हल् के वाजणजकयक एयर कंडीिनर के लेबल पर संप्रदशितित स्ट् टार लेबल अजधजनयम की धारा 14 के खंड (क) और पूवोय जवजनबंधन में उपबंजधत दकए गए जनबंधन और ितों के अधीन अजधसूजचत हल्क े वाजणजकयक एयर कंडीिनर के जलए ऊजाा उपभोग मानक के अनझरूप होगा;

(ड.) अनझज्ञापत्रधारी प्रजत लेबल तीस रुपए की लेबल फीस का संदाय करेगा; (च) अनझज्ञापत्रधारी जवत्तीय वषा की प्रत्येक जतमाही के अंत में कगामी मास के भीतर प्रत्येक जतमाही के जलए लेबलीकृत उपस्ट्कर के उत्पादन के ब् यौर का एक जववरण ब्यरू ो को प्रस्ट्ततझ करेगा। वही ब्यौरे ब्यरू ो को एक स्ट्वचाजलत प्रणाली के माध्यम से भी प्रस्ट्ततझ दकए जाएंगे;

NOTIFICATION New Delhi, the 27 February, 2023 No. BEE/S&L/LCAC/37/2022-23.- Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Light Commercial Air Conditioners) Regulations, 2022, were published vide notification number BEE/S&L/LCAC/37/2022-23 as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said notification in the Official Gazette;

And whereas copies of the said draft regulations were made available to the public on 24th August, 2022;

And whereas suggestions have been received with respect to the said draft regulations within the period aforesaid;

And whereas the suggestions received in this regard have been taken into consideration;

Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of

2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations,

namely:

1. Short title and commencement.– (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Light Commercial Air Conditioners) Regulations, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.- (1) In these regulations, unless the context otherwise requires,-

(a) ―Act‖ means the Energy Conservation Act, 2001(52 of 2001);

(b) ―Form‖ means a form appended to these regulations;

(c) ―label‖ means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the light commercial air conditioner;

(d) ―Light Commercial Air Conditioners‖ means room air conditioner specified in the notification under clause (b) of section 14 of the Act. It covers light commercial air conditioner having rated capacity above 10,500 Watts up to and including 18,000 Watts;

(e) ―label period‖ means the validity period of the energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, by the ending timeline of the label validity period, the new energy consumption standards under section 14 (a) of the Act are not notified, the existing standards shall deemed to be valid until new values for the same are notified by the Central Government;

(f) ―permittee‖ means a person or agency to whom permission has been granted to affix label under regulation 7;

(g) ―Schedule‖ means the schedule annexed to these regulations;

(h) ―Star rating or Star level‖ means the grade of energy efficiency displayed on the label of the light commercial air conditioner based on energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act;

(i) ―trader or seller‖ in relation to any light commercial air conditioner means a person who sells or distributes such light commercial air conditioner and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such air conditioner.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have meanings respectively assigned to them in the Act.

3. Particulars to be displayed on label.- (1) On every light commercial air conditioner, the following particulars shall be displayed on its label, namely:-

(a) star level;

(b) indian Seasonal Energy Efficiency Ratio;

(c) label validity period;

(d) appliance or type of air conditioner;

(e) the name of manufacturer or importer and brand;

(f) model or year of manufacturing or import;30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(g) cooling capacity (hundred per cent.) in Watts;

(h) cooling capacity (fifty per cent.) in Watts;

(i) electricity Consumption in units per year;

(j) compressor Type;

(k) logo of the Bureau of Energy Efficiency;

(l) name of appliance; and

(m) unique series code;

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.-

(1) Transition from Voluntary to Mandatory Regime.- A label containing all the particulars specified in regulation 3 shall be displayed on every light commercial air conditioner within a period of six months from the date of coming into force of these regulations.

(2) Revision of Mandatory Energy Consumption Standards.- On and from commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act for the appliance, every permittee or trader or seller.-

(a) shall not produce the light commercial air conditioner with previous energy consumption standards;

(b) shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the light commercial air conditioner in synchronisation with revised energy consumption standards;

(c) shall take necessary preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken three months in advance.

5. Manner of display of label.-(1) Every manufacturer, seller or trader shall display on either side of front panel of every light commercial air conditioner a label at the time of sale and the label shall be either adhere to, or be attached as a swing tag, on it.

(2) For units not on display, the label may be attached to the exterior of the casing of the light commercial air conditioner and the label may be attached to the unit when the unit is removed from its packaging or the label may be included as a part of the documentation given to the customer or user.

6. Permission for display of label.-(1) No star label shall be affixed on a light commercial air conditioner without obtaining the prior permission of the Bureau.

(2) Company registration.- For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees, payable by any

acceptable electronic mode of payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration.- Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by any acceptable electronic mode of payment; and

(b) documents specified in Form I – (B).

7. Grant of permission. -(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labeling, subject to such terms and conditions as specified in regulation 8, –

(a) register the brand in Form II-(A) or in electronic form; and

(b)grant permission for affixing label on light commercial air conditioner in Form II-(B) or in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of permittee therein.

(3) The permission granted under sub-regulation (1) shall be valid for the duration for which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 is in force.

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

Provided that in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.[भाग III—खण् ड 4] भारत का राजपत्र : असाधारण 31

(5) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II – (B).

(6) No application shall be renewed after expiry of validity period, in which case the permittee may make a fresh application.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the light commercial air conditioner from the date from which the revised star level comes into force shall submit a declaration according to Form IV.

(8) The permittee shall seek permission to affix a label afresh, if a new model of the light commercial air conditioner is to be launched synchronising with the revised star level, and application for such permission shall be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label.- Every permittee, seller or trader shall comply with the following terms and conditions in displaying the particulars on label, namely:—

(a) the star level displayed on the label of the light commercial air conditioner shall conform to energy consumption standards notified under clause (a) section 14 of the Act;

(b) the label shall be affixed only on such model of light commercial air conditioner for which permission has been granted;

(c) the label shall be printed and affixed on the light commercial air conditioner at the cost of the permittee;

(d) star level displayed on the label of light commercial air conditioner shall be maintained at all time;

(e) pay the label fee as specified in regulation;

(f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers and sellers appointed to sell their labelled products by 30th day of April of each year; and

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Operation Manual on Standards and Labelling.

9. Label fee. - (1) Every permittee shall pay to the Bureau a label fee of rupees thirty on each label affixed on the light commercial air conditioner.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of closure

of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security fee made under sub-regulation

(2) of regulation 6 and if the total amount of labeling fee is not recovered within one year of the last date of payment, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.

10. Refund of label security deposit.-Subject to the proviso to sub-regulation (2) of regulation 9, a permittee shall be entitled to refund of the label security fee on ceasing to manufacture light commercial air conditioner.

11. Verification by Bureau.-(1) The Bureau may, either suo motu, or on a complaint received by it, carry out verification to ensure that the light commercial air conditioner conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission. All tests including the power consumption, capacity tests, power factor and maximum operating condition tests shall be conducted by the Bureau or through its designated agency using enthalpy method or calorimeter for the purpose of verification and challenge testing.

(2) For the purpose of verification, the samples shall be picked up at random by the Bureau or its designated agency from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the light commercial air conditioner in an independent laboratory duly accredited by the National Accreditation Board for Testing and Calibration Laboratories, and a notice shall be issued to the permittee in Form V for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau.

(4) If the sample drawn under challenge testing fails, all expenses as specified shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and where the equipment passes the challenge test, then the expenses deposited by the complainant shall be forfeited.32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(5) Where a sample of light commercial air conditioner used for testing fails the test during suo motu testing or challenge testing, the Bureau shall offer the permittee another opportunity and conduct a second test with twice the quantity of light commercial air conditioner used in the first test, in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by the National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee.

(6) The Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub-regulation

(3) or the second test referred to in sub-regulation (4) and the expenses to be made towards the procurement and testing of sample.

(7) Where, the permittee fails to make such expenses, the Bureau shall -

(a) continue the verification by challenge testing referred to in sub-regulation (3) or the second test referred to in sub-regulation (4);

(b) stop further processing of application received under regulation 6;

(c) cancel all the labels granted to the permittee under regulation 7, after six months from the date of issuance of Form V.

(8) Where the second test fails, the Bureau shall -

(a) direct the permittee in Form VI, under intimation to all the State designated agencies, that the permittee within a period of two months shall,-

(i) correct the star level displayed on the label of the light commercial air conditioner or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months;

(c) intimate to the concerned State designated agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(9)The permittee shall, within ten days of the conclusion of the period of two months referred to in sub-regulation

(7) send the compliance report in Form VII to the Bureau with respect to action taken in compliance with the direction.

(10) If the compliance report referred to in sub-regulation (8) is not received or received without complying to any of the direction within the specified period, it shall be deemed to have been not complied with the direction issued and the Bureau shall order to that effect.

(11) The Bureau shall send the compliance report referred to in sub-regulation (8) and orders passed in sub- regulation (9) to all the State designated agencies for the purpose of taking action under section 17 and enforcement of order passed under the sub-regulation (9).

(12) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (7), the Bureau shall,-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send a report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause

(a) of section 14, the orders issued by the Bureau under clause (a) for consideration and for taking action by the Central Government under clause (c) of section 14;

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months; and

(d) intimate to the concerned State designated agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission. - The Bureau may cancel the permission granted under regulation 7, if the permittee,-

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) fails to comply with the directions issued under regulation 11 and

4. The details of the product and the suo motu test results (if applicable) is enclosed with this letter. Now, therefore in pursuance of the provisions of sub-regulation (1) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Light Commercial Air Conditioner) Regulations, 2023, the Bureau is conducting suo motu test or challenge test (as applicable) on ……..(date) at …………(Name of laboratory), accredited by National Accreditation Board for Testing and Calibration Laboratories.

(ii) deposit such cost towards procurement, transportation, testing and other incidental expenses as mentioned in Annexure, within fifteen days from the date of issuance of this letter (the expenses shall be deposited through an electronic mode).

5. Pursuant to the provisions of clause (a) of sub-regulation (4) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of light commercial air conditioner) Regulations, 2023, you are hereby directed to comply with the following, namely:- • correct the star level displayed on the label of the light commercial air conditioner or remove the defects and deficiencies found during testing;

• withdraw all the stocks from the market to comply with the directions of the Bureau; and • change the particulars displayed on advertising material.

6.You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VII within ten days after the expiry of two months that is, by………………………………………………………………..

7.In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of sub- regulation(5) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Light Commercial Air Conditioner) Regulations, 2023.
