और इस िवषय म(cid:7286) (cid:7079)ा(cid:7385) सझु ाव(cid:7298) पर िवचार (cid:7408)कया गया ह;ै अत: अब, क(cid:7286)(cid:7076)ीय सरकार के पवू (cid:6981) अनमु ोदन स े (cid:7011)यूरो उ(cid:7334) अिधिनयम क(cid:7409) धारा 58 क(cid:7409) उपधारा (2) ख(cid:7003)ड (i) के साथ प(cid:7407)ठत धारा 14 के ख(cid:7003) ड (घ) और धारा 13 क(cid:7409) उपधारा (2) के ख(cid:7003)ड (ढ) (cid:7367)ारा (cid:7079)द(cid:7275) शि(cid:7334)य(cid:7298) का (cid:7079)योग करत े (cid:7263)ए िन(cid:7013) निलिखत िविनयम बनाती ह,ै अथा(cid:6981)त ्:-

1. सिं(cid:6979)(cid:7385) नाम और (cid:7079)ारंभ.—(1) इन िविनयम(cid:7298) का सिं (cid:6979)(cid:7385) नाम ऊजा(cid:6981) द(cid:6979)ता (cid:7011)य रू ो (भंडार (cid:7408)क(cid:7021)म के जल हीटर के लेबल(cid:7298) पर उनके सं(cid:7079)दश(cid:6981)न क(cid:7409) िविशि(cid:7397)यां और रीित), िविनयम, 2016 ह।ै

(2) ये राजप(cid:7074) म(cid:7286) उनके अिं तम (cid:7079)काशन क(cid:7409) तारीख को (cid:7079)वृ(cid:7004)त ह(cid:7298)गे।

2. प(cid:7407)रभाषा.— (1) इन िविनयम(cid:7298) म,(cid:7286) जब तक संदभ (cid:6981)से अ(cid:7008)य था अपेि(cid:6979)त न हो,- 4357 GI/2015 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] (क)(cid:32) ''अिधिनयम” से ऊजा (cid:6981)सरं (cid:6979)ण अिधिनयम, 2001 अिभ(cid:7079)ते ह;ै (ख)(cid:32) “(cid:7079)(cid:7272)प” स ेइन िविनयम(cid:7298) स ेउपाबंध (cid:7079)(cid:7272)प अिभ(cid:7079)ते ह;ै (ग)(cid:32) “लेबल” स ेजल के हीटर पर िचपकाया गया या (cid:7079)द(cid:7414)शत िलिखत, मु(cid:7408)(cid:7076)त, िचि(cid:7022)नत, मुहर लगी या (cid:7061)ा(cid:7408)फक साम(cid:7061)ी अिभ(cid:7079)ते ह;ै (घ)(cid:32) “लेबल अविध” स े अिधिनयम क(cid:7409) धारा 14 के खंड (क) के अधीन क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा िविन(cid:7416)द(cid:7020)ट ऊजा (cid:6981) हािन मानक के अधीन (cid:7021)थायी हािन क(cid:7409) िविधमा(cid:7008)य ता अविध अिभ(cid:7079)ेत ह ै और य(cid:7408)द (cid:7021)थायी हािन क(cid:7409) िविधमा(cid:7008)य ता क(cid:7409) अविध क(cid:7409) अिं तम अविध िविन(cid:7416)द(cid:7020)ट नह(cid:7277) क(cid:7409) गई ह,ै इस अविध को के(cid:7008)(cid:7076) ीय सरकार (cid:7367)ारा िविन(cid:7416)द(cid:7020)ट नए मू(cid:7016)य (cid:7298) तक िविधमा(cid:7008) य मानी जाएगी;

(ङ)(cid:32) “मॉडल या मॉडल(cid:7298) के प(cid:7407)रवार” से (cid:7408)कसी िविश(cid:7020)ट (cid:7081)ा(cid:7003)ड का मॉडल या मॉडल(cid:7298) क(cid:7409) (cid:7088)णे ी ह ैिजसके संबंध म(cid:7286) परी(cid:6979)ण (cid:7407)रपोट(cid:7300) का एकल समु(cid:6994) चय लागू ह ैऔर जहा ं (cid:7079)(cid:7004)य के मॉडल के समान भौितक ल(cid:6979)ण, (cid:7021)थायी हािन, ऊजा (cid:6981)कुशलता (cid:7021) तर और िन(cid:7020) पादन िविश(cid:7397)ताए ंसमान अिभ(cid:7079)ेत ह;(cid:7289) (च)(cid:32) “अन(cid:6980)ु ाधारक” स ेऐसे (cid:7018) यि(cid:7334) या अिभकरण स ेह ैिजसे िविनयम 7 के अधीन लेबल िचपकाने के िलए अन(cid:6980)ु ा दी गई अिभ(cid:7079)ते ह;ै (छ)(cid:32) “(cid:7021)टार रे(cid:7411)टग या (cid:7021)टार (cid:7021)तर स े जल हीटर क(cid:7409) ऊजा(cid:6981) िन(cid:7020)पाद को (cid:7007)योितत करने के िलए अिधिनयम क(cid:7409) धारा 14 के खंड (क) के अधीन अिधसिू चत िव(cid:7378)ुत भंडारण जल हीटर(cid:7298) के (cid:7021)तर पर (cid:7079)द(cid:7414)शत (cid:7021)थायी हािन ((cid:7408)क. वॉ. घ.ं/ 24 हास/(cid:6981) 45 स)े क(cid:7409) (cid:7088)णे ी अिभ(cid:7079)ते ह ैl (ज)(cid:32) “(cid:7018) यापारी या िव(cid:7059)ेता” से ऐसा (cid:7018)य ि(cid:7334) जो जल हीटर क(cid:7409) िब(cid:7059)(cid:7409) या िवतरण करता ह ै और िजसके अंतग(cid:6981)त ऐस े दकु ानदार, (cid:7018) यापारी, िविनमा(cid:6981)ता और जल हीटर पर लेबल िचपकान े के िलए अनमु ित (cid:7079)ा(cid:7385) अनु(cid:6980)ाधारक अिभ(cid:7079)ते ह ैl (झ)(cid:32) “जल के हीटर” से अिभ(cid:7079)ेत ह ै जो अिधिनयम क(cid:7409) धारा 14 के ख(cid:7003)ड (ख) के अधीन अिधसूचना म (cid:7286) यथािविन(cid:7416)द(cid:7020)ट सािध(cid:7074) ह।ै

(2) यहां इसम(cid:7286) (cid:7079)यु(cid:6989) त जो श(cid:7011) द और अिभ(cid:7018)य ि(cid:7334)या ं अप(cid:7407)रभािषत ह (cid:7289) (cid:7408)क(cid:7008)त ु अिधिनयम म (cid:7286) प(cid:7407)रभािषत ह,(cid:7289) उनका अिधिनयम म(cid:7286) उ(cid:7008) ह (cid:7286)(cid:7059)मश: (cid:7408)दया गया अथ (cid:6981)ही होगा।

3. लबे ल पर (cid:7079)द(cid:7414)शत (cid:7408)कए जान े वाली िविशि(cid:7397)या.ं—(1) (cid:7079)(cid:7004)य ेक जल के हीटर पर, इसके लेबल पर िन(cid:7013)न िलिखत िविशि(cid:7397)या ं(cid:7079)द(cid:7414)शत क(cid:7409) जाएगी, अथात(cid:6981) ्:- (क)(cid:32) ऊजा (cid:6981)द(cid:6979)ता (cid:7011) यरू ो का (cid:7079)तीक िच(cid:7022)न;

(ख)(cid:32) उपकरण; (ग)(cid:32) (cid:7081)ांड का नाम; (घ)(cid:32) िविनमाण(cid:6981) या आयात का मॉडल का नाम, स(cid:6990)ं य ा और वष;(cid:6981) (ङ)(cid:32) रेटेड (cid:6979)मता (लीटर); (च)(cid:32) रेटेड इनपुट पावर ((cid:7408)क. वॉ.) (वा(cid:7021) तिवक जाचं ) (छ)(cid:32) (cid:7021) थायी हािन ((cid:7408)क. वॉ. घं. / 24 घंटे / 45 िड(cid:7061)ी से.) ;

(ज)(cid:32) लेबल क(cid:7409) अविध; (झ)(cid:32) (cid:7021) टार (cid:7021) तर; और (ञ)(cid:32) िवशेष (cid:7088)ृंखला कोड;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3

(2) लेबल का िडजाइन, रंग, आकार और अतं (cid:7414)व(cid:7397) इन िविनयम(cid:7298) के साथ उपांबध अनुसचू ी म (cid:7286)यथा िविन(cid:7416)द(cid:7020)ट होगा।

4. लबे ल(cid:7298) के स(cid:7079)ं दश (cid:6981) के िलए समय-सीमा.—(1) िविनयम 3 म (cid:7286) िविन(cid:7416)द(cid:7020)ट सभी िविशि(cid:7397)य(cid:7298) वाला लेबल इन िविनयमन(cid:7298) के लागू होन ेक(cid:7409) तारीख स ेछह मास क(cid:7409) अविध के भीतर (cid:7079)(cid:7004)य के जल के हीटर पर (cid:7079)द(cid:7414)शत (cid:7408)कया जाएगा।

(2) अिधिनयम क(cid:7409) धारा 14 के ख(cid:7003) ड (क) के अधीन लाग ू सशं ोिधत ऊजा (cid:6981)हािन मानक(cid:7298) के (cid:7079)ारंभ होन ेपर और (cid:7079)ारंभ होन ेस,े (cid:7079)त य् ेक अनु(cid:6980)ाधारक या (cid:7018) यापारी या िव(cid:7059)ेता सि ु नि(cid:7391)त करेगा (cid:7408)क – क) िव(cid:7059)य हते ु रखे गए जल हीटर, संशोिधत ऊजा(cid:6981) उपभोग मानक(cid:7298) के साथ स(cid:7013)कािलक होते (cid:7263)ए संशोिधत (cid:7021)टार लेवल और संशोिधत लेवल अविध दशा(cid:6981)यगे ा और जल हीटर का िविनमा(cid:6981)ण वष(cid:6981) भी ऐस े संशोिधत ऊजा (cid:6981)उपभोग मानक(cid:7298) के समकालीन होगा, और जल हीटर का िनमा(cid:6981)ण पूव(cid:6981)वत(cid:7278) ऊजा(cid:6981) उपभोग मानक(cid:7298) के साथ नह(cid:7277) करेगा l ख) (cid:7390)ौहारी, खुदरा (cid:7018) यापा(cid:7407)रय(cid:7298) को जानकारी दने े के िलए उनक(cid:7409) जाग(cid:7272)कता के साथ ही उपभो(cid:6989)त ा(cid:7312) को िशि(cid:6979)त करने के िलए अपेि(cid:6979)त (cid:7079)चार-(cid:7079)सार सिहत सभी (cid:7079)ारंिभक उपाय इन िविनयम(cid:7298) के अधीन ऐस े (cid:7079)ारंभ क(cid:7409) तारीख स ेछह माह पूव(cid:6981) िनयोिजत (cid:7408)कए जाएगं ।े

5. लबे ल (cid:7079)द(cid:7414)शत करन ेक(cid:7409) रीित.—(1) इकाई के सामन े वाल े स(cid:7013)(cid:7079)दश (cid:6981) पर लेबल लगाया जाएगा और यह िविनयम 3 के उपिविनयम (2) म(cid:7286) सरलता से (cid:7408)दखाई दने ा चािहए और अनु(cid:6980)ाधारक सिु नि(cid:7391)त करेगा (cid:7408)क (cid:7079)(cid:7004)य ेक रिज(cid:7021)(cid:7069)ीकृत इकाई या मॉडल पर पहचान के (cid:7079)योजन के िलए स(cid:7013)(cid:7079)दश(cid:6981) म(cid:7286) लेबल िब(cid:7059)(cid:7409) या (cid:7408)कराए के (cid:7410)बद ुपर (cid:7408)दखाई दते ा ह ैऔर यह लेबल इकाई या मॉडल सिहत के(cid:7410)सग के बाहर म(cid:7408)ु (cid:7076)त या िचपकाया गया होगा।

(2) (cid:7079)द(cid:7414)शत नह(cid:7277) क(cid:7409) गई इकाइय(cid:7298) के िलए लेबल इकाई या मॉडल सिहत के(cid:7410)सग के बाहर मु(cid:7408)(cid:7076)त या िचपकाया जाए और यह लेबल इकाई या मॉडल पर लगाया जाए, जब इकाई या मॉडल को इसक(cid:7409) प(cid:7412)ै कग स ेबाहर िनकाला जाता ह ैया लेबल को (cid:7061)ाहक या (cid:7079)यो(cid:6989) ता को (cid:7408)दए जान ेवाले द(cid:7021) तावेज के भाग के (cid:7272)प म (cid:7286)सि(cid:7013)मिलत (cid:7408)कया जाए।

6. लबे ल स(cid:7079)ं द(cid:7414)शत करन े क(cid:7409) अन(cid:6980)ु ा.—(1) (cid:7011)य ूरो क(cid:7409) पूव(cid:6981) अनु(cid:6980)ा के िबना िव(cid:7378)तु ् जल के हीटर पर कोई (cid:7021)ट ार नह(cid:7277) िचपकाया जाएगा।

(2) उप- िविनयम (1) के अधीन (cid:7011) यूरो क(cid:7409) अन(cid:6980)ु ा लेन े के (cid:7079)योजन के िलए, आवेदन (cid:7079)(cid:7272)प - I म(cid:7286) और इले(cid:6989)(cid:7069) ॉिनक (cid:7079)(cid:7272)प म (cid:7286)(cid:7408)कया जाएगा:

परंत ुजल के हीटर के (cid:7079)(cid:7004) यके मॉडल के प(cid:7407)रवार के िलए पृथक आवेदन (cid:7408)कया जाए;

(3) उप- िविनयम (2) के अधीन (cid:7079)(cid:7004) यके आवेदन- प(cid:7074) के साथ िन(cid:7013)न िलिखत सलं (cid:6991)न ह(cid:7298)ग े– (क)(cid:32) ऊजा (cid:6981) द(cid:6979)ता (cid:7011) यरू ो, नई (cid:7408)द(cid:7016)ल ी के प(cid:6979) म (cid:7286) दो हजार (cid:7271)पए का आवेदन फ(cid:7409)स अथवा भुगतान के (cid:7408)कसी (cid:7079)ित(cid:7061)ाहय इले(cid:6989) (cid:7069)ॉिनक ढंग म(cid:7286) दये होगा;

(ख)(cid:32) ऊजा (cid:6981) द(cid:6979)ता (cid:7011) यरू ो, नई (cid:7408)द(cid:7016)ल ी के प(cid:6979) म (cid:7286) दये एक लाख (cid:7271)पए क(cid:7409) लेबल जमानत रािश; मांग प(cid:7074) या भुगतान के (cid:7408)कसी (cid:7079)ित(cid:7061)ाहय इले(cid:6989)(cid:7069) ॉिनक ढंग म:(cid:7286) परंत,ु लघु उ(cid:7378)ोग के मामल ेम,(cid:7286) जमानत रािश केवल प(cid:6994)च ीस हजार (cid:7271)पए होगी-; और (ग)(cid:32) यथा: िविन(cid:7416)द(cid:7020) ट द(cid:7021) तावेज (cid:7079)(cid:7272)प I4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

7. अन(cid:6980)ु ा (cid:7079)दान करना.—(1) िविनयम 6 के अधीन कोई आवदे न (cid:7079)ा(cid:7009)त होने पर और इससे सतं ु(cid:7020)ट होन ेपर (cid:7408)क इसम(cid:7286) दी गई सभी अपे(cid:6979)ा(cid:7312) का पालन (cid:7408)कया गया ह,ै (cid:7011)य ूरो ऐसी (cid:7079)ाि(cid:7385) क(cid:7409) तारीख से एक मास क(cid:7409) अविध के भीतर, िविनयम 8 म (cid:7286) यथा: िविन(cid:7416)द(cid:7020) ट िनबधं न(cid:7298) एवं शत(cid:7300) के अ(cid:7007) यधीन जल के हीटर पर (cid:7079)(cid:7272)प-2 या इले(cid:6989)(cid:7069) ॉिनक (cid:7079)(cid:7272)प म (cid:7286) लबे ल िचपकाने के िलए अनु(cid:6980)ा (cid:7079)दान कर सकता ह।ै

(2) (cid:7011) यूरो, (cid:7079)(cid:7272)प -3 म(cid:7286) रिज(cid:7021) टर बनाकर रखेगा और इसम (cid:7286) अनु(cid:6980)ाधारक के नाम (cid:7079)िव(cid:7020)ट करेगा, िजसके एक डटे ा बेस का भी रखरखाव (cid:7408)कया जाएगा।

(3) उप- िविनयम (1) के अधीन इस (cid:7079)कार (cid:7079)द(cid:7275) अनु(cid:6980)ा उस अविध तक िविधमा(cid:7008)य होगी जो के(cid:7008)(cid:7076) ीय सरकार (cid:7367)ारा धारा 14 के ख(cid:7003) ड (क) के अधीन यथा: अिधसिू चत ऊजा(cid:6981) हािन मानक (cid:7367)ारा (cid:7021)ट ार (cid:7021)त र के िलए िविन(cid:7416)द(cid:7020)ट क(cid:7409) गई ह।ै

(4) अनु(cid:6980)ाधारक (cid:7367)ारा अन(cid:6980)ु ा के नवीकरण के िलए आवेदन छह मास के भीतर (cid:7412)कत ु इस अविध क(cid:7409) समाि(cid:7385) से तीन मास पूव (cid:6981) (cid:7408)कया जाएगा। ऐसा आवेदन, अनु(cid:6980)ा क(cid:7409) समाि(cid:7385) स े कम स े कम तीन मास पूव(cid:6981) (cid:7408)कया जाएगा और इसके साथ ऊजा (cid:6981) द(cid:6979)ता (cid:7011) यरू ो, नई (cid:7408)द(cid:7016)ल ी के प(cid:6979) म (cid:7286)मांग प(cid:7074) के (cid:7272)प म (cid:7286)या इले(cid:6989)(cid:7069) ॉिनक ढंग म (cid:7286)एक हजार (cid:7271)पए का दये फ(cid:7409)स होना चािहए।

(5) िविधमा(cid:7008) यता क(cid:7409) अविध समा(cid:7009)त होन े के प(cid:7019)च ात ् (cid:7408)कसी आवेदन का नवीकरण नह(cid:7277) (cid:7408)कया जाएगा और अनु(cid:6980)ाधारक को नया आवेदन प(cid:7074) (cid:7079)(cid:7021) तुत करना होगा।

(6) उप- िविनयम (4) के अधीन नवीकरण के िलए, आवेदन-प(cid:7074) िमलन े पर और सभी अपे(cid:6979)ा(cid:7312) का अनुपालन होन े के संबंध म(cid:7286) समाधान होने पर, (cid:7011) यूरो ऐसा आवेदन (cid:7079)ा(cid:7009)त होन े क(cid:7409) तारीख से एक मास क(cid:7409) अविध के भीतर (cid:7079)(cid:7272)प-2 म(cid:7286) अन(cid:6980)ु ा का नवीकरण कर सकता ह।ै

(7) जो अनु(cid:6980)ाधारक उस तारीख से जल के हीटर के मौजूदा मॉडल पर लेबल िचपकाने को जारी रखने क(cid:7409) अन(cid:6980)ु ा क(cid:7409) मांग करता ह,ै िजस तारीख स ेसंशोिधत (cid:7021) टार (cid:7021)त र लागू (cid:7263)आ ह,ै केवल (cid:7079)(cid:7272)प 4 म(cid:7286) एक घोषणा (cid:7079)(cid:7021)त ुत करेगा।

(8) य(cid:7408)द िव(cid:7378)ुत् जल के हीटर के नए मॉडल क(cid:7409) योजना संशोिधत (cid:7021)ट ार (cid:7021)त र के साथ सम(cid:7059)मण कर शु(cid:7272) करन े क(cid:7409) ह ै तो अनु(cid:6980)ाधारक को नया लेबल िचपकाने क(cid:7409) अनु(cid:6980)ा लेगा और ऐसी अनु(cid:6980)ा के िलए आवेदन संशोिधत (cid:7021)ट ार (cid:7021)त र के लाग ू होन े से छह मास पूव(cid:6981) (cid:7408)कया जाए।

8. लबे ल पर िविशि(cid:7397)या ं (cid:7079)द(cid:7414)शत करन े के िलए िनबंधन और शत.(cid:7288)—(cid:7079)(cid:7004)य के अनु(cid:6980)ाधारक और (cid:7018)य ापारी और िव(cid:7059)ेता िन(cid:7013) निलिखत िनबंधन(cid:7298) एवं शत(cid:7300) का पालन करेगा, अथात(cid:6981) :- (क)(cid:32) जल के हीटर के लेबल पर (cid:7079)द(cid:7414)शत (cid:7021)ट ार (cid:7021)त र अिधिनयम क(cid:7409) धारा 14 के ख(cid:7003)ड (क) के अधीन क(cid:7286)(cid:7076)ीय सरकार अिधसिू चत जल के हीटर के िलए ऊजा(cid:6981) हािन मानक(cid:7298) के अन(cid:7272)ु प ह(cid:7298)गे। (ख)(cid:32) यह लेबल जल के हीटर के ऐस ेमॉडल(cid:7298) पर ही िचपकाया जाएगा िजसके िलए अन(cid:6980)ु ा (cid:7079)दान क(cid:7409) गई ह।ै (ग)(cid:32) लेबल को अन(cid:6980)ु ाधारक क(cid:7409) लागत पर म(cid:7408)ु (cid:7076)त और जल के हीटर पर िचपकाया जाएगा। (घ)(cid:32) अनु(cid:6980)ाधारक, (cid:7018) यापारी और िव(cid:7059)ेता यह सुिनि(cid:7391)त करेगा (cid:7408)क जल के हीटर पर लबे ल पर (cid:7079)द(cid:7414)शत (cid:7021)ट ार (cid:7021)त र हर समय बना रहगे ा। (ङ)(cid:32) अनु(cid:6980)ाधारक िविनयम 9 म(cid:7286) यथा: िविन(cid:7416)द(cid:7020)ट लेबल फ(cid:7409)स का भगु तान करेगा।¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 5 (च)(cid:32) अनु(cid:6980)ाधारक (cid:7011) यरू ो को िविशि(cid:7397)या ं दये करेगा िजसम (cid:7286) लेबल लगे उप(cid:7021)क र(cid:7298) को बनाने का (cid:7011)य ौरा और िव(cid:7275)ीय वष(cid:6981) क(cid:7409) (cid:7079)(cid:7004) येक ितमाही के अतं म (cid:7286) िन(cid:7013)न िलिखत मास के भीतर (cid:7079)(cid:7004)य के ितमाही के िलए दये (cid:7079)ो(cid:7006)भूत लब े (cid:7410)लग फ(cid:7409)स क(cid:7409) िविशि(cid:7397)यां हो। (छ)(cid:32) अनु(cid:6980)ाधारक, (cid:7011) यरू ो को अपन े लेबल लग े उ(cid:7004)प ाद(cid:7298) क(cid:7409) िब(cid:7059)(cid:7409) के िलए िनयु(cid:6989)त (cid:7079)(cid:7004)य के वष (cid:6981) क(cid:7409) 30 अ(cid:7079)लै या उसस ेपहले अिधकृत िवतरक(cid:7298), (cid:7018)य पा(cid:7407)रय (cid:7298) और थोक िव(cid:7059)ेता(cid:7312) एवं िव(cid:7059)ेता(cid:7312) क(cid:7409) सूची दगे ा। (ज)(cid:32) अनु(cid:6980)ाधारक, (cid:7018) यापारी और िव(cid:7059)ेता ऐस े अ(cid:7008)य िनबंधन(cid:7298) एव ं शत(cid:7300) का पालन कर(cid:7286)गे जो (cid:7011)य ूरो (cid:7367)ारा, मानक और लेब(cid:7410)लग के संबंध म (cid:7286) (cid:7011)य ूरो क(cid:7409) िनदि(cid:7287) शका म (cid:7286) अंत(cid:7414)व(cid:7020)ट िनबंधन(cid:7298) और शत(cid:7300) सिहत िविन(cid:7416)द(cid:7020)ट (cid:7408)कए गए ह(cid:7298)।

9. लबे ल फ(cid:7409)स.—(1) (cid:7079)(cid:7004) येक अनु(cid:6980)ाधारक, (cid:7011)य ूरो को िव(cid:7378)ुत् जल के हीटर पर (cid:7079)(cid:7004) येक िचपकाए गए लेबल के िलए दो (cid:7271)पए क(cid:7409) फ(cid:7409)स का भुगतान करेगा।

(2) उप-िविनयम (1) के अधीन िविन(cid:7416)द(cid:7020)ट लेबल फ(cid:7409)स, (cid:7079)(cid:7004)य ेक िव(cid:7275)ीय वष (cid:6981)क(cid:7409) अिं तम तारीख स ेएक मास के भीतर वा(cid:7414)षक तौर पर संद(cid:7275) (cid:7408)कया जाएगा:

परंतु यथा िविन(cid:7416)द(cid:7020) ट अविध के भीतर लेबल फ(cid:7409)स के भुगतान म(cid:7286) चकू पर, (cid:7011)य ूरो िविनयम 6 के उप-िविनयम (3) के ख(cid:7003) ड (ख) के अधीन (cid:7079)ितभूित िन(cid:6979)ेप से इस पर दस (cid:7079)ितशत (cid:7079)ित वष(cid:6981) क(cid:7409) दर स े इस पर (cid:7011)य ाज के साथ बकाया रकम वसलू करेगा औरय(cid:7408)द इसे जमा (cid:7408)कए जाने क(cid:7409) अंितम तारीख से एक वष(cid:6981) के भीतर पूरा लेब(cid:7410)लग शु(cid:7016)क वसूल नह(cid:7277) (cid:7408)कया जाता, (cid:7011)य ूरो अनु(cid:6980)ाधारक को (cid:7079)द(cid:7275) सभी अनु(cid:6980)ा र(cid:7374) कर सकता ह ैऔर अन(cid:6980)ु ाधारक का नाम (cid:7018)य ित(cid:7059)मी के (cid:7272)प म(cid:7286) समाचार प(cid:7074) म(cid:7286) (cid:7079)कािशत कर सकता ह।ै

10. लबे ल जमानत फ(cid:7409)स का (cid:7079)ितदाय.—िविनयम 9 के उप-िविनयम (2) के उपबंध(cid:7298) के अ(cid:7007)य धीन, अनु(cid:6980)ाधारक िव(cid:7378)ुत् जल के हीटर का िविनमा(cid:6981)ण न करन ेपर लेबल जमानत फ(cid:7409)स के (cid:7079)ितदाय का हकदार होगा।

11. (cid:7011)य रू ो (cid:7367)ारा स(cid:7004)य ापन.—(1) (cid:7011) यूरो अथवा इसक(cid:7409) नामिन(cid:7416)द(cid:7020)ट अिभकरण, (cid:7021)व यमेव अथवा इस े िशकायत (cid:7079)ा(cid:7009)त होने पर, यह सिु नि(cid:7391)त करने के िलए स(cid:7004)य ापन करेगा (cid:7408)क जल के हीटर के लेबल पर (cid:7079)द(cid:7414)शत (cid:7021)ट ार (cid:7021)त र और अ(cid:7008)य िविशि(cid:7397)य(cid:7298) के अन(cid:7272)ु प है और (cid:7408)क यह अनु(cid:6980)ा के अ(cid:7008) य िनबंधन(cid:7298) एवं शत(cid:7300) के अनुपालन म (cid:7286)ह।ै

(2) स(cid:7004)यापन (cid:7079)योजन के िलए, (cid:7011)यूरो या नामिन(cid:7416)द(cid:7397) अिभकरण, िविनमा(cid:6981)ता सुिवधा या भ(cid:7003)डागार या फुटकर िव(cid:7059)य क(cid:7286)(cid:7076) स,े जसै ा वह उिचत समझ,े यादिृ(cid:6994)छक तौर पर नमूने एक(cid:7074) करेगा l

(3) जहां उप- िविनयम (1) के अधीन िशकायत (cid:7079)ा(cid:7009)त होने पर, (cid:7011)य ूरो (cid:7367)ारा जांच और अशं ाकं न (cid:7079)योगशाला(cid:7312) हते ु रा(cid:7020) (cid:7069)ीय परी(cid:6979)ण (cid:7079)(cid:7004) यायन बोड (cid:6981) (एनएबीएल) (cid:7367)ारा स(cid:7013)यक (cid:7079)(cid:7004)य ाियत (cid:7021)व तं(cid:7074) (cid:7079)योगशाला म (cid:7286) जल के हीटर क(cid:7409) जांच पर आ(cid:6979)पे कर स(cid:7004)य ापन करना अपिे (cid:6979)त ह,ै वहां अनु(cid:6980)ाधारक को ऐसे परी(cid:6979)ण के िन(cid:7020)प ादन के िलए नो(cid:7407)टस जारी (cid:7408)कया जाएगा और िशकायतकता(cid:6981) स े (cid:7011)य ूरो के पास परी(cid:6979)ण, प(cid:7407)रवहन संबंधी खच(cid:6981) और अ(cid:7008)य आकि(cid:7021)मक (cid:7018)य य, ऐसी समयाविध म(cid:7286) जमा कराने क(cid:7409) मांग क(cid:7409) जाएगी जो (cid:7011) यूरो (cid:7367)ारा अवधा(cid:7407)रत क(cid:7409) गई हो और य(cid:7408)द आ(cid:6979)पे परी(cid:6979)ण के अधीन िलए गए नमनू े िवफल रहत े ह(cid:7289), (cid:7011) यूरो को नमूने लेने, नमून े के प(cid:7407)रवहन और जांच (cid:7079)भार(cid:7298) क(cid:7409) लागत के िलए सभी (cid:7018)य य क(cid:7409) (cid:7079)ितप(cid:7414)ू त अनु(cid:6980)ाधारक (cid:7367)ारा क(cid:7409) जाएगी और (cid:7011) यरू ो उि(cid:7016)लिखत (cid:7018) यय िशकायतकता (cid:6981) को (cid:7079)ितदाय करेगा और जहा ं उप(cid:7021)क र आ(cid:6979)पे परी(cid:6979)ण पर पास हो जात े ह,(cid:7289) तब िशकायतकता (cid:6981)(cid:7367)ारा जमा कराए गए (cid:7018) यय ज(cid:7011)त कर िलए जाएंगे।

(4) जहां परी(cid:6979)ण के िलए जल के हीटर के नमूने (cid:7021)व यमवे परी(cid:6979)ण अथवा आ(cid:6979)ेप परी(cid:6979)ण के दौरान परी(cid:6979)ण म (cid:7286) असफल रहते ह,(cid:7289) वहां अनु(cid:6980)ाधारक को एक अ(cid:7008)य अवसर (cid:7408)दया जाएगा और (cid:7011)य ूरो, अनु(cid:6980)ाधारक क(cid:7409) लागत पर रा(cid:7020)(cid:7069) ीय परी(cid:6979)ण6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4] और अंशाकं न (cid:7079)योगशाला बोड (cid:6981) (एनएबीएल) (cid:7367)ारा स(cid:7013)य क (cid:7272)प स े (cid:7079)(cid:7004)याियत (cid:7021)व तं(cid:7074) (cid:7079)योगशाला म(cid:7286) (cid:7079)थम जांच म(cid:7286) (cid:7079)यु(cid:6989)त जल के हीटर के दो गुने प(cid:7407)रमाण म (cid:7286)दसू रा परी(cid:6979)ण करेगा;

(5) जहां, दसू रा परी(cid:6979)ण असफल होता ह,ै (cid:7011)य ूरो,- (क)(cid:32) (cid:7079)(cid:7272)प 5 म(cid:7286) अनु(cid:6980)ाधारक को सभी रा(cid:6996)य नामो(cid:7408)(cid:7374)(cid:7020)ट अिभकरण(cid:7298) को िनदशे दगे ा (cid:7408)क (cid:7079)(cid:7272)प 5 के जारी होन े क(cid:7409) तारीख स ेअनु(cid:6980)ाधारक दो मास क(cid:7409) अविध के अंदर करेगा;

i.(cid:32) िव(cid:7378)ुत जल के हीटर के लेबल पर (cid:7079)द(cid:7414)शत (cid:7021)ट ार (cid:7021)त र सही करेगा या परी(cid:6979)ण के दौरान (cid:7074)ु(cid:7407)टय(cid:7298) और किमय(cid:7298) को दरू करेगा;

ii.(cid:32) (cid:7011) यूरो के (cid:7408)दशा- िनदश(cid:7287) (cid:7298) के अनुपालन म (cid:7286)बाजार स ेसभी (cid:7021) टॉक को वापस लेगा; और iii.(cid:32) िव(cid:6980)ािपत साम(cid:7061)ी पर (cid:7079)द(cid:7414)शत िविश(cid:7397)ताए ंम(cid:7286) प(cid:7407)रवत(cid:6981)न करेगा;

(ख)(cid:32) उपभो(cid:6989) ता(cid:7312) के लाभ के िलए, (cid:7011)य ूरो के अिभिहत अिभकरण स े जांच प(cid:7407)रणाम(cid:7298) क(cid:7409) (cid:7079)ाि(cid:7385) क(cid:7409) तारीख से, दो मास के भीतर अन(cid:6980)ु ाधारक का नाम, (cid:7081)ा(cid:7003)ड का नाम, मॉडल का नाम या मॉडल सं(cid:6990)य ा, (cid:7079)तीक िच(cid:7022)न और अ(cid:7008) य िविनदश(cid:7287) (cid:7408)कसी दिैनक रा(cid:7020)(cid:7069) ीय अथवा (cid:7079)ादिे शक समाचारप(cid:7074) अथवा इल(cid:6989)े (cid:7069) ॉिनक अथवा जो वह ठीक समझ(cid:7286) (cid:7408)कसी अ(cid:7008) य रीित से (cid:7079)कािशत करेगा;

(ग)(cid:32) संबंिधत रा(cid:6996) य नामिन(cid:7416)द(cid:7020)ट अिभकरण को अिधिनयम, क(cid:7409) धारा 27 के अधीन अनु(cid:6980)ाधारक और (cid:7018) यापारी के िव(cid:7272)(cid:7373) (cid:7008) यायिनण(cid:6981)यन कार(cid:6981)वाई करने के िलए ससं िू चत करेगा।

(6) अन(cid:6980)ु ाधारक उप-िविनयम (5) म(cid:7286) िन(cid:7416)द(cid:7020)ट दो मास क(cid:7409) अविध समा(cid:7009)त होने के दस (cid:7408)दन के भीतर,- (क)(cid:32)(cid:7011) यूरो को (cid:7408)दशा-िनदश(cid:7287) के अनुपालन म(cid:7286) क(cid:7409) गई कार(cid:6981)वाई के सबं ंध म(cid:7286) (cid:7079)(cid:7272)प 6 म (cid:7286) अनपु ालन (cid:7407)रपोट(cid:6981) भेजेगा;

और (ख)(cid:32) य(cid:7408)द ख(cid:7003) ड (क) म (cid:7286) िन(cid:7416)द(cid:7020) ट अनपु ालन (cid:7407)रपोट(cid:6981) (cid:7079)ा(cid:7009)त नह(cid:7277) (cid:7263)ई ह ै या िविन(cid:7416)द(cid:7020)ट अविध के भीतर िनदश(cid:7287) का पालन (cid:7408)कए िबना (cid:7079)ा(cid:7009)त होती ह,ै इस े जारी िनदश(cid:7287) (cid:7298) का अनअनुपालन माना जाएगा और (cid:7011)य रू ो (cid:7367)ारा इस (cid:7079)भाव के आदशे जारी कर (cid:7408)दए जाएंग।े

(7) (cid:7011) यूरो अिधिनयम क(cid:7409) धारा 17 के अधीन कार(cid:6981)वाई करने और उ(cid:6989)त उप-िनयम के खंड (ख) के अधीन पा(cid:7407)रत आदशे (cid:7298) के (cid:7079)वत(cid:6981) न के (cid:7079)योजन के िलए सभी रा(cid:6996)य अिभिहत अिभकरण(cid:7298) को खंड (क) (ख) म (cid:7286)िन(cid:7416)द(cid:7020)ट अनपु ालन (cid:7407)रपोट(cid:6981) और उप-िविनयम (6) के खंड (ख) म(cid:7286) जारी आदशे (cid:7298) क(cid:7409) (cid:7079)ित, आव(cid:7019)य क द(cid:7021)त ावेज(cid:7298) सिहत भजे गे ा;

(8) जहा ं अनु(cid:6980)ाधारक, (cid:7011)यूरो (cid:7367)ारा उप िविनयम- (5) के तहत जारी (cid:7408)कए गए (cid:7408)दशािनदश(cid:7287) (cid:7298) के अनुपालन म (cid:7286) ता हअै सफल रह, वहां (cid:7011)यरू ो सभी रा(cid:6996)य नामो(cid:7408)(cid:7374)(cid:7397) अिभकरण(cid:7298) को सूचना दते े (cid:7263)ए – (क)(cid:32) िविनयम 7 के उप िविनयम- (1) के तहत अनु(cid:6980)ाधारक को (cid:7079)द(cid:7275) स(cid:7013)मित वापस ल ेलेगा;

(ख)(cid:32)के(cid:7008)(cid:7076)ीय सरकार को, अिधिनयम क(cid:7409) धारा 14 के खंड (क) के अधीन क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा अिधसूिचत ऊजा (cid:6981) हािन मानक(cid:7298) क(cid:7409) अनु(cid:7272)पता म(cid:7286) अनु(cid:6980)ाधारक (cid:7367)ारा िवफलता क(cid:7409) पुि(cid:7397) म (cid:7286)परी(cid:6979)ण (cid:7407)रपोट(cid:6981) के साथ, क(cid:7286)(cid:7076)ीय सरकार (cid:7367)ारा¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 7 अिधिनयम क(cid:7409) धारा 14 के खडं (ग) के अधीन िवचार करन े और कार(cid:6981)वाई करने के िलए उप-ि विनयम (6) के खडं (क) म (cid:7286)िन(cid:7416)द(cid:7020) ट (cid:7011) यूरो क(cid:7409) िनदश(cid:7287) (cid:7407)रपोट(cid:6981) भेजेगा। (ग)(cid:32) उपभो(cid:7334)ा(cid:7312) के लाभ के िलए, दो मास के भीतर, (cid:7408)कसी रा(cid:7398)ीय या (cid:7079)ादिे शक दिै नक समाचार प(cid:7074) म (cid:7286) और (cid:7408)कसी इले(cid:6989)(cid:7069)ॉिनक या (cid:7408)कसी अ(cid:7008) य रीित स े जैसा (cid:7011)य ूरो (cid:7367)ारा ठीक समझ े जाए, अनु(cid:6980)ाधारक का नाम, (cid:7081)ांड नाम, मॉडल का नाम या मॉडल सं(cid:6990)या, सं(cid:7079)तीक और अ(cid:7008)य िविनदश(cid:7287) न (cid:7079)कािशत करेगा;

(घ)(cid:32) संबंिधत रा(cid:6996) य अिभिहत अिभकरण(cid:7298) को अिधिनयम क(cid:7409) धारा 27 के अधीन अन(cid:6980)ु ाधारक और (cid:7018)य ापारी के िव(cid:7271)(cid:7373) आगे िविधक कार(cid:6981)वाई श(cid:7272)ु करने के िलए सिू चत करेगा।

12. अन(cid:6980)ु ा का र(cid:7374)करण.—(cid:7011)यूरो, िविनयम 7 के अधीन (cid:7079)द(cid:7275) अनमु ित को र(cid:7374) कर सकता ह,ै य(cid:7408)द अनु(cid:6980)ाधारक – िविनयम 7 के तहत िविन(cid:7416)द(cid:7397) (cid:7408)कसी िनयम और शत(cid:6981) का पालन नह(cid:7277) करता;

(क)(cid:32)िविनयम 8 के अधीन िविन(cid:7416)द(cid:7397) िनबंधन और शत(cid:7300) का अनुपालन नह(cid:7277) करता; (ख)(cid:32)िविनयम 9 के अधीन िविन(cid:7416)द(cid:7397) अविध के भीतर लेबल फ(cid:7409)स का संदाय नह(cid:7277) करता;

2. िविनमा(cid:6981)ण सुिवधा: उपरो(cid:6989) त उप(cid:7021) कर भारत म(cid:7286) ___________ (कंपनी का नाम) (cid:7367)ारा िविन(cid:7414)मत (cid:7408)कया जाता ह ै और ___________ (कारखाने का नाम और पता) म(cid:7286) िविन(cid:7414)मत (cid:7408)कया जाता ह ै या उपरो(cid:6989)त उपकरण भारत के बाहर ___________(कारखान ेका नाम और पता) (cid:7367)ारा िविन(cid:7414)मत (cid:7408)कया जाता ह ैऔर भारत म(cid:7286) ___________ (कंपनी का नाम) (cid:7367)ारा बेचा जाता ह ै।

NOTIFICATION New Delhi, the 7th September, 2016 No. BEE/S&L/Water Heater/3/2015-16.—Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2016 were published (cid:118)(cid:105)(cid:101)(cid:100) notification number BEE/S&L/Water Heater/3dated the 4th January, 2016, as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of forty-five days from the date of publication of the said notification in the Official Gazette;

And whereas copies of the said draft regulations were made available to the public on 4th January 2016;

And whereas the suggestions received in this regard have been taken in to consideration;

Now therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the said Act, the Bureau, with the previous approval of the Central Government, hereby makes the following regulations, namely:-

1. Short title and commencement.—(1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage Type Electric Water Heater) Regulations,

2016.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.—(1) In these regulations, unless the context otherwise requires,-

(a)(cid:32) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “Form” means a form appended to these regulations;

(d) “label period” means the validity period of the standing loss under energy consumption standard specified by the Central Government under clause (a) of section 14 of the Act and in case the end period of the validity period of the standing loss is not specified, it shall be deemed to be valid until new values for the same are specified by the Central Government;

(e) “models or family of models” means the model or range of models of one particular brand, to which a single set of test reports is applicable and where each of the models has the same physical characteristics, standing loss value, energy efficiency rating and performance characteristics;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 23

(f) “permittee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(g) “star rating or star level” means the grade of standing loss (kWh/24hr/450C) displayed on the label of the electric storage water heaters notified under clause (a) of section 14 of the Act to denote the energy performance of water heater;

(h) “trader or seller” in relation to any labeled water heater means a person who sells or distributes any such water heater and includes trader, manufacturer and permittee given permission to affix label on such water heater;

(i) “water heater” means an appliance as specified in the notification under clause (b) of section 14 of the Act.

(2) Words and expressions used herein and not defined, but defined in the Act, shall have the same meanings respectively as assigned to them in the Act.

3. Particulars to be displayed on label.—(1) On every water heater, the following particulars shall be displayed on its label, namely:-

(a)(cid:32) the logo of Bureau of Energy Efficiency;

(b)(cid:32) equipment;

(c)(cid:32) brand name;

(d)(cid:32) model name, number and year of manufacturing or import;

(e)(cid:32) rated capacity (Litre);

(f)(cid:32) rated input power (kW) (Actual Tested);

(g)(cid:32) standing loss (kWh/24 hr/450C);

(h)(cid:32) label period;

(i) star level; and

(j) unique series code.

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.

4. Time limit for display of labels.—(1) A label containing all the particulars specified in regulation 3 shall be displayed on every water heater within a period of six months from the date of coming into force of these regulations.

(2) On and from commencement of the energy performance standards under clause (a) of section 14 of the Act, every permittee shall ensure that

(a) the water heater put on sale shall display revised star level and revised label period synchronizing with the revised energy consumption standards and the manufacturing year of the water heater shall also be in synchronization with such revised energy consumption standards, and shall not produce the water heater with the previous energy consumption standards;

(b) all the preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers shall be well planned and taken six months in advance of the date of commencement under these regulations.

5. Manner of display of label.—(1) The label shall be affixed at the front display of the unit and should be easily visible as referred in sub-regulation (2) of regulation 3 and the permittee shall ensure that the label appears on every registered unit or model on display for identification purpose, at point of sale or hire and the label shall also be printed or pasted to the exterior to the casing containing the unit or model.

(2) For units not on display, the label may be printed or pasted to the exterior to the casing and this label may be attached to the unit or model when the unit or model is removed from its packaging or the label may be included as a part of the documentation given to the customer or user.

6. Permission for display of label.—(1) No star label shall be affixed on an electric water heater without obtaining the prior permission of the Bureau.

(2) For the purpose of obtaining permission of the Bureau under sub-regulation (1) an application shall be made in Form-I and in electronic form:

Provided that separate application shall be made for each model of electric water heater.

(3) Every application under sub-regulation (2) shall be accompanied by –

(a) an application fee of two thousand rupees, payable by demand draft in favour of Bureau of Energy Efficiency, New Delhi or by any acceptable electronic mode of payment;

(b) a label security fee of one lakh rupees, payable by demand draft in favour of Bureau of Energy Efficiency, New Delhi; or by any acceptable electronic mode of payment:

Provided that in case of small scale industry label security fee shall be only twenty -five thousand rupees; and

7. Grant of permission.—(1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period of one month from the date of such receipt, grant, subject to terms and conditions as are specified in regulation 8, permission for affixing label on water heater in Form II or in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein, a database of which shall also be maintained.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till which the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 is in force.

(4) An application for renewal of permission shall be made by the permittee from six months but not later than three months before its expiry of permission and such application shall be accompanied by a fee of one thousand rupees payable in the form of demand draft or electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, shall renew permission in Form II.

(7)(cid:32) The permittee who seeks permission for continuance to affix label on the existing model of the electric water heater from the date from which the revised star level comes into force shall submit only a declaration as per Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the electric water heater is planned to be launched to synchronise with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label. – Every permittee, trader and seller shall comply with the following terms and conditions in displaying the particulars on label, namely:-

(a) the star level displayed on the label of water heater shall conform to energy consumption standards for water heater notified by the Central Government under clause (a) of section 14 of the Act ;

(b) the label shall be affixed only on such model of water heater for which permission has been granted;

(d) the permittee, trader and seller shall ensure that the star level displayed on the label of water heater shall be maintained at all time;

(e) the permittee shall pay the label fee as specified in regulation 9;

(f) the permittee shall furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labeling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) the permittee shall furnish to the Bureau an updated list of authorised distributors, dealers, retailers and sellers appointed to sell their labeled products, on or before the 30th day of April of every year;

(h) the permittee, trader and seller shall comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labeling.

9. Label fee.—(1) Every permittee shall pay to the Bureau a label fee of two rupees on each label affixed on the electric water heater.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of

closure of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau may recover the amount due with interest thereon at ten per cent. per annum from the label security deposit made under clause (b) of sub- regulation (3) of regulation 6, and if complete labeling fees are not recovered within one year of the last date of submission, the Bureau may cancel all labels granted to the permittee and publish the name of the permittee in the newspapers as a defaulter.¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 25

10. Refund of Label Security deposit.—Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security fee, on ceasing to manufacture of that particular model of electric water heater.

11. Verification by Bureau.—(1) The Bureau of Energy Efficiency or its designated agency may, either (cid:115)(cid:117)(cid:111)(cid:32) (cid:116)(cid:109)(cid:111)(cid:117) , or on a complaint received by it, carry out verification to ensure that the water heater conforms to the star level and other particulars displayed on its label and that it complies with the other terms and conditions of permission

(2) For the purpose of verification, the Bureau or its designated agency shall procure samples in random, from the manufacturing facility, warehouse or the retail outlet as it deems fit.

(3) Where upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification, by challenge testing the water heater in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL), a notice shall be issued to the permittee for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau; and if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund expenses to the complainant, the user of the label to the complainant; and where the sample passes the challenge test, then, the expenses deposited by the complainant shall stand forfeited.

(4) Where samples of water heater used for testing fails the test during (cid:111)(cid:115)(cid:117)(cid:32)(cid:111)(cid:116)(cid:109)(cid:117) testing or challenge testing, the permittee shall be afforded another opportunity and the Bureau shall conduct a second test with twice the quantity of water heater used in the first test in an independent test laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories (NABL) at the cost of the permittee.

(5) Where the second test fails, the Bureau shall,-

(a) direct the permittee in Form V, under intimation to all the State Designated Agencies, that the permittee shall, within a period of two months from the date of issuance of Form V,

(i)(cid:32) correct the star level displayed on the label of the electric water heater or remove the defects and deficiencies of the failed model, found during the verification conducted as per regulation 11;

(ii)(cid:32) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii)(cid:32) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit within two months from the date of receipt of test results from Bureau’s designated agency;

(c) intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(6) The permittee shall within ten days of the conclusion of the period of two months referred to in sub- regulation (5),

(a)(cid:32) send the compliance report as per Form VI to the Bureau with respect to action taken in compliance with the direction; and

(b)(cid:32) where the compliance report referred to in clause (a) is not received or received without complying to any of the direction within aforesaid specified period, it shall be deemed as non-compliance of the direction issued and necessary orders to that effect shall be passed by the Bureau.

(7) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause (b) of sub- regulation (6) of regulation 11 to all the State Designated Agencies for the purpose of taking action under section 17 of Act and enforcement of the order passed under clause (b) of the said sub-regulation.

(8) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (5), the Bureau under intimation to all State Designated Agencies, shall,-

(a)(cid:32) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b)(cid:32) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy consumption standards notified by the Central Government under clause

(a) of section 14 of the Act, the directions of the Bureau referred to in clause (a) of sub-regulation (5) of regulation 11 for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;

(c)(cid:32) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as deemed fit by the Bureau within two months of sending report to the Central Government as mentioned in clause (b);26 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(d)(cid:32) intimate the concerned State Designated Agencies to initiate further legal proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission.- The Bureau may cancel the permission granted under regulation 7, if the permittee –

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee in accordance with production data, within the period specified under regulation 9;

1. Pursuant to the provisions of regulation 7 of the Bureau of Energy Efficiency (Particulars and Manner of their display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2016, the Bureau hereby permits you to affix label as per details of approvals set out in the Annexure to this Form II.

2. This permission is subject to—

(a) the star level displayed on the label of the electric water heater shall conform to energy consumption standards for stationary storage type electric water heater notified under clause

(a) of the Act and terms and conditions provided in the aforesaid regulations;

(b) the label shall be affixed only on such model of electric water heater for which permission has been granted;

(d) the permittee shall ensure that the star level displayed on the electric water heater shall be maintained at least till the validity of the label or validity of their registration;

(e) the permittee shall pay the labeling fee of two rupees per label;30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(f) the permittee shall furnish (in hard copy as well as through Standards & Labeling online web- portal) to the Bureau a statement containing details of production of labelled equipment and the labelling fee payable for each quarter within a period of thirty days of the close of that quarter of the financial year;

(g) the permittee shall make available such other details of electric water heater as and when sought by the Bureau for which the permission has been granted.

3. This permission shall be valid from ............................... to .............................and may be renewed as prescribed. The permittee shall not withdraw the electric water heater from the market during the validity period of permission except with the prior approval of the Bureau.

4. The unique label series code assigned by Bureau of Energy Efficiency for the equipment is............. which should be clearly visible on the label as per the approved design.

5. Whenever the star level plan is amended or modified by the Bureau, the star level of the electric water

heater shall be modified as follows:-(cid:32)

(a) if new model is launched synchronizing with the revised star level, an application for such permission shall be made to Bureau six months in advance of the date from which new star level comes in to force;

(b)Where the existing model is continued to give effect to the modified star level, only a declaration as per Form IV shall be submitted to the Bureau.

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled water heater failed to meet the standing loss (kWh/24 hrs/450C), standard, specified volume capacity etc. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the Electric Water Heater manufactured/imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... ..... dated........in the name of your authorised contact person . You were also requested to attend and witness the Second Check Verification Test of the samples at the NABL Accredited Laboratory M/s....................................................

5. The Sample for second check verification test, were picked up in accordance with paragraph 6 of S.O. number …. dated the …. through our authorised Agency M/s. ............and transported to the NABL accredited Laboratory transported by our authorised Agency, duly sealed by M/s............... and was given Unique Identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6. The Test results are contained in Second Test Verification Report duly prepared checked and counter signed by the competent authorized personnel of the NABL Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing. The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O. number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Electric Water Heater manufactured/imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (4) of Regulation 11of the Bureau of Energy Efficiency (Particulars and Manner of display of Label on Stationary Storage Type Electric Water Heater) Regulations, 2016, the Bureau hereby directs to:-

(i)(cid:32) correct the star level displayed on the label of the Electric Water Heater or remove the defects and deficiencies found during testing;

(ii)(cid:32) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii)(cid:32) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within 10 days after the expiry of two months i.e. by .............. .In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of sub- regulation (5) of Regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2016

9. The Bureau shall take further follow up action in the matter in terms of sub-regulations (4), (5), (6), (7) and (8) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their display on Labels of Stationary Storage Type Electric Water Heater) Regulations, 2016.
