और, उपय ाय अवजध के भीतर उय प्रारूप जवजनयम के संबंध में स झाव प्राति हुए ह;ैं और, एस संबंध में प्राति स झाव पर जवचार दकया गया ह;ै अत: अब, ऊजाा संरक्षण अजधजनयम, 2001 (2001 का 52) की धारा 13 की उपधारा (2) के खंड (ढ़) और धारा 14 का खंड (घ) के साथ पठित धारा 58 के उपधारा (2) के खंड (i) द्वारा प्रदत् त िजयय का प्रयोग करत े हुए, केंद्रीय सरकार के पूवा अन मोदन स े ऊजाा दक्षता ब् यूरो (स्ट् टेिनरी भंडारण प्रकार के जवध त ् जल हीटर पर प्रदिान के जववरण और जवजध) जवजनयम, 2016, संिोधन करने के जलए जनम्नजलजखत जनयम बनाता बनाती ह,ै अथाात्:- 8286 GI/2022 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

1. लघ िीर्ाक और करम् भ .- (1) एन जवजनयम का संजछति नाम ऊजा ा दक्षता ब्यरू ो (स्ट् टेिनरी भंडारण प्रकार जवध त ् जल हीटर पर प्रदिना के जववरण और जवजध) (संिोधन) जवजनयम, 2022 ह।ै

(2) ये राजपरित में एनके प्रकािन की तारीख स ेप्रवृत् त ह गे।

2. ऊजाा दक्षता ब्यरू ो (स्ट् टेिनरी भंडारण प्रकार के जवध त् जल हीटर पर प्रदिान के जववरण और जवजध), (संिोधन), जवजनयम, 2022 (जजससे एसम ें एसके पश्चात उय जवजनयम कहा जाएगा), "एलजे क्रक वॉटर हीटर" और "वॉटर हीटर िब्द के स्ट् थान पर, जहां कहीं भी ये प्रय क् त होते ह,ैं "स्ट् टोरेज वाल ेस्ट् टेिनरी एलेजक्रक वाटर हीटर" िब् द को रखा जाएगा।

3. उय जवजनयम में जवजनयम 4 के स्ट्थान पर जनम्नजलजखत जवजनयम रखा जाएगा, अथाात्:- "4. लेबल प्रदर्शित करन े की समय सीमा.-

(1) स्ट्वैजछछक स े अजनवाया व् यवस्ट् था म ें पठरवतान - जवजनयम 3 में जनर्ददष्ट सभी जववरण वाला एक लेबल एन जवजनयम के लाग ू होन े की तारीख से छह महीने की अवजध के भीतर प्रत्येक स्ट् टोरेज वाल े स्ट् टेिनरी प्रकार के जवध त ् जल हीटर पर प्रदर्शित दकया जाएगा।

(2) अजनवाया ऊजाा खपत मानक का पन रीक्षण - अजधजनयम की धारा 14 के खंड (क) के अधीन केन्‍द द्रीय सरकार द्वारा अजधसूजचत संिोजधत ऊजाा खपत मानक के प्रारंभ होन े पर, प्रत्येक अन ज्ञाधारी या व्यापारी या जवक्रेता, - (क) जपछले ऊजाा खपत मानक के साथ स्ट् टोरेज वाल ेस्ट् टेिनरी जवध त् जल हीटर का उत्पादन नहीं करेगा;

(ख) स्ट् टोरेज वाल े स्ट् टेिनरी जवध त ् जल हीटर संिोजधत ऊजा ा खपत मानक और संिोजधत ऊजाा खपत मानक के साथ ससक्रनाएजेिन म ें स्ट् टोरेज वाल े स्ट् टेिनरी जवध त ् जल हीटर के जनमााण वर् ा के साथ संिोजधत स्ट्टार स्ट्तर और लेबल अवजध प्रदर्शित करेगा;

(ग) डीलर , ख दरा व् यापाठरय को जानकारी देन े के जलए, उनको जिजक्षत करने के साथ ही उपभोक्त ाओं क को जिजक्षत करन े के जलए अपेजक्षत प्रचार-प्रसार सजहत सभी प्रारंजभक कदम समय रहत ेउिाए जान े चाजहए।

4. उय जवजनयम के जवजनयम 6 के स्ट्थान पर जनम्नजलजखत जवजनयम रखा जाएगा, अथाात्: "6. लेबल प्रदर्शित करने की अन ज्ञा - (1) ब्यूरो की पूवा अनम जत प्राति दकए जबना स्ट्टेिनरी स्ट्टोरेज प्रकार के जवध त् जल हीटर पर कोई स्ट्टार लेबल नहीं लगाया जाएगा।

(2) ब्यूरो की अन ज्ञा प्राति करने के प्रयोजन के जलए, प्रत्येक ब्ांड को एक लाख रुपए के लेबल प्रजतभूजत ि ल् क के साथ, अलग से रजजस्ट् रीकृत दकया जाएगा जैसा दक प्ररूप I - (क) में जवजनर्ददष् ट दकया गया ह,ै भ गतान के एल क्े र ाजनक मोड द्वारा देय ह:ै

(3) उपजवजनयम (2) के अधीन अनज्ञ ाधारक के प्रत्येक कवेदन के साथ- (क) भ गतान के एलेक्रॉजनक मोड द्वारा देय प्रजत मॉडल दो हजार रुपए का कवेदन ि ल्क; तथा (ख) एलेक्रॉजनक मोड द्वारा देय एक लाख रुपय ेका एक लेबल स रक्षा ि ल्क:

परन्‍द त लघ उयोगोग के मामले म ेंलेबल स रक्षा ि ल्क पचीसीस हजार रुपए होगा; तथा (ग) प्ररूप I में जवजनर्ददष्ट दस्ट्तावेज।

5. उय जवजनयम के जवजनयम 7 म,ें - (क) उपजवजनयम (1) के स्ट् थान पर, जनम्नजलजखत उपजवजनयम को रखा जाएगा, अथाात् -[भाग III—खण् ड 4] भारत का राजपरित : असाधारण 3 ''(1) जवजनयम के खंड 6 के अधीन कोई कवेदन प्राति होने पर और एससे संत ष्ट होने पर दक एसमें दी गई सभी अपेक्षाओं क का पालन दकया गया ह,ै ब्यूरो मानक और लेबसलग पर ऐसी प्राजति की तारीख से ब् यूरो मानक और लेबसलग के मनै अल म ें जवजनर्ददष् ट अवजध के अदं र, जवजनयम 8 में यथा जवजनर्ददष् ट जनयम एवं िततों के अ्‍ यधीन अनज्ञ ा प्रदान करता ह,ै- (क) प्ररूप II-(क) म ेंएलेक्रॉजनक रूप में ब्ांड रजजस्ट् रीकृत करना; या (ख) प्ररूप II में एलेक्रॉजनक रूप में स्ट् टोरेज वाल ेस्ट् टेिनरी एलेजक्रक वाटर हीटर पर लेबल लगाने की अन ज्ञा देना। (ख) उप जवजनयम (4) के स्ट्थ ान पर जनम्न जलजखत उप जवजनयम रखा जाएगा। "(4) स्ट्टार रेटटग योजना के पन रीक्षण के मामले में, अन ज्ञा के नवीनीकरण के जलए एक कवेदन अन ज्ञाधारी द्वारा एसकी समाजति से एक माह पहले नहीं दकया जाएगा और एसके साथ ऊजाा दक्षता ब् यूरो नई ददल्ल ी के पक्ष में एलेक्रॉजनक मोड म ें देय एक हजार रुपए का िल् क दये होगा। परन्‍द त स्ट्टार रेटटग योजना के जवस्ट्तार के मामल े में, एक हजार रुपये के उय नवीनीकरण िल् क से छूट दी जाएगी।"

6. उय जवजनयम म,ें - (क) प्ररूप I म,ें िब्द और अक्षर, "डीडी नंबर द्वारा", दोन स्ट्थान पर, िब्द "एलेक्रॉजनक मोड द्वारा" रखा जाएगा। (ख) प्ररूप I के पश् चात,् जनम्नजलजखत प्ररूप और उपाबंध जोडा जाएगा, अथाात:् - ''प्ररूप I-(क) (जवजनयमन 6(2) देख ें) (कंपनी के लटे र हडे म ेंमद द्रत दकया जाना ह)ै ऊजाा दक्षता ब्यरू ो (स्ट् टेिनरी भडं ारण प्रकार के जवध त् जल हीटर पर प्रदिान के जववरण और जवजध), (संिोधन), जवजनयमन 2022 के अधीन स्ट् टेिनरी भंडारण प्रकार जवध त ्जल हीटर ब्ैंड के रजजस्ट् रीकरण के जलय ेकवेदन महाजनदेिक ऊजाा दक्षता ब्यरू ो (जवयोग त मंरितालय, भारत सरकार) चौथा तल, सेवा भवन, सेक्टर-1, कर.के.प रम, नई ददल्ली- 110 066 भारत.

1. ऊजाा दक्षता ब्यूरो (स्ट् टेिनरी भंडारण प्रकार के जवध त् जल हीटर पर प्रदिान के जववरण और जवजध), (संिोधन), जवजनयमन 2022 के प्रावधान के अन सार ब्यरू ो कपको अपना ब्ैंड एस परित के उपाबंध म ें जनधााठरत अन मोदन के जववरण के अन सार रजजस्ट् रीकृत कराने की अन मजत देता ह।ै

2. यह अन मजत जनम्नजलजखत के अधीन हिःै - (क) लेबल पर लगाया गया स्ट्टार लेबल अजधजनयम की धारा 14 के खडं (क) के अधीन अजधसूजचत स्ट्टेिनरी स्ट्टोरेज टाईप एलेजक्रक वॉटर हीटर के ऊजाा उपभोग मानक और जवजनयमन के जनयम और िततों के अनरू प होना चाजहये;

(ख) लेबल की म हर केवल ऐसे स्ट् टेिनरी भंडारण प्रकार जवयोग त जल हीटर पर लगायी जाये जजसके जलये अन मजत दी गयी ह;ै (ग) स्ट् टेिनरी भंडारण प्रकार जवयोग त जल हीटर पर लेबल की छपाई और लगाये जान े का खचा अन मजत प्राति कता ा द्वारा वहन दकया जायेगा;

(घ) अन मजत प्राति कताा को स जनजश्चत करना होगा दक स्ट् टेिनरी भडं ारण प्रकार जवयोग त जल हीटर पर लगाया गया स्ट्टार लेबल हर समय बना रह;े (ङ) अन मजत प्राति कताा ब्यरू ो द्वारा जवजनर्ददष्ट लेबल ि ल्क करे; (च) अन मजत प्राति कताा ब्यरू ो के पास एक बयान जमा करेगा जजसमें लेबलय य उपकरण के जवजनमााण और जवत्तीय वर्ा की प्रत्येक जतमाही के बाद वाल े महीन े में प्रत्येक जतमाही के प्रोद्भूत लेबल ि ल्क का ब्योरा होगा। यह समान जानकारी एक स्ट्वचाजलत प्रणाली के मा्‍यम स ेभी ब्यूरो में जमा करायी जायेगी;

(छ) अन मजत प्राति कताा अन मजत मंजरू करने वाले ब्यूरो द्वारा मांगे जाने पर स्ट् टेिनरी भंडारण प्रकार जवयोग त जल हीटर के अन्‍दय जववरण भी उपलब्ध करायगें े;

3. अन मजत प्राति कताा ब्यूरो की पवू ा अन मजत के जसवाय सत्यापन अवजध के दौरान रजजस्ट् रीकृत ब्ैंड और स्ट् टेिनरी भंडारण प्रकार जवयोग त जल हीटर बाजार से नहीं हटाय़ेंगे।

4. ब्ैंड के जलये ऊजाा दक्षता ब्यरू ो द्वारा प्रदत्त जवजिष्ट लेबल श्ृंखला ............ह ैऔर एसे अन मोददत जडजाईन के अन सार लेबल पर दिााया जाना चाजहये।

NOTIFICATION New Delhi, the 12th December, 2022 No.BEE/S&L/WaterHeater/3/2022-23.- Whereas the draft regulations namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage type Electric Water Heater) Regulations, 2022, were published vide notification number BEE/S&L/Water Heater/3/2015-16 as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001), inviting objections or suggestions from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said

notification in the Official Gazette;

And whereas, copies of the said draft regulations were made available to the public on 27th June, 2022;

And whereas, suggestions have been received with respect to the said draft regulations within the period aforesaid;

And whereas, the suggestions received in this regard have been taken into consideration;12 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of

2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations to amend the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage type Electric Water Heater) Regulations, 2016, namely:-

1. Short title and commencement.- (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage Type Electric Water Heater),

(Amendment) Regulations, 2022.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Stationary Storage type Electric Water Heater), (Amendment) Regulations, 2022 (hereinafter referred to as the said regulations), for the words ―Electric Water Heater‖ and ―Water Heater, wherever they occur, the words ―Stationary Storage type Electric Water Heater‖ shall be substituted.

3. For regulation 4 of the said regulations, the following regulation shall be substituted, namely:- ―4. Time limit for display of labels.—

(1) Transition from Voluntary to Mandatory regime.- A label containing all the particulars specified in regulation 3 shall be displayed on every stationary storage type electric water heater within a period of six months from the date of coming into force of these regulations.

(2) Revision of Mandatory Energy Consumption Standards.- On and from the commencement of revised energy consumption standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller, —

(a) shall not produce the stationary storage type electric water heater with the previous energy consumption standards;

(b) the stationary storage type electric water heater shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the stationary storage type electric water heater in synchronization with revised energy consumption standards;

(c) al l preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken in advance.‖

4. For regulation 6 of the said regulations, the following regulation shall be substituted, namely: “6. Permission for display of label. - (1) No star label shall be affixed on a Stationary Storage type Electric Water Heater without obtaining the prior permission of the Bureau.

(2) For the purposes of obtaining permission of the Bureau, every brand shall be registered separately as specified in Form I – (A), accompanied by a label security fee of one lakh rupees, payable by electronic mode of payment.

(3) Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by electronic mode a n d

(b) a label security fee of one lakh rupees, payable by electronic mode:

Provided that in case of small scale industry label security fee shall be twenty -five thousand rupees; and

(c) documents specified in Form I .

5. In regulation 7 of the said regulations,-

(a) For sub-regulation (1), the following sub-regulation shall be substituted, namely:- ― (1) On receipt of an application under clause no. 6 of the regulation and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in its Manual on standards and labelling, subject to such terms and conditions as specified in regulation 8, –

(a) grant permission to register the brand in Form II-(A) or in electronic form; and[भाग III—खण् ड 4] भारत का राजपरित : असाधारण 13

(b) grant permission for affixing label on stationary storage type electric water heater in Form II or in electronic form.’’

(b) for sub-regulation (4), the following sub-regulation shall be substituted, namely:- ―(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi.

Provided that in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.‖

6. In the said regulations,-

(a) In Form I, for the word and letter, ―by DD NO‖, occurring at both the places, the words ―by Electronic mode‖ shall be substituted.

(b) after Form I, the following Form and annexure shall be inserted, namely:-- “FORM I – (A) [See regulation 6 (2)] (To be printed in Company letter head) Application for registration of brand of Stationary Storage Type Electric Water Heater under the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Stationary Storage Type Electric Water Heater heater) Regulations, 2022 To The Director General Bureau of Energy Efficiency, (Ministry of Power, Government of India) 4th Floor, Sewa Bhawan, Sector-I, R.K. Puram, New Delhi – 110 066, India.

I/We am/are the manufacturer/manufacturers of Stationary Storage Type Electric Water Heater carrying out business at....................................................... (full business address) under the style of (full name of individual or firm) hereby apply for permission to affix label on Stationary Storage Type Electric Water Heater as specified by the Bureau in the Bureau of Energy Efficiency (Particulars and Manner of their Display of the Label on Stationary Storage Type Electric Water Heater) Regulations, 2022.

The details of the information in respect of the equipment, company, manufacturing facility and payment is given in Annexure. A photocopy of the certificate of incorporation issued by the Registrar of Firms or Societies or Director of Industries (in case of Small Scale Units) or similar other documents authenticating the name of the firm and its manufacturing premises is enclosed.

6. I/We agree to abide by all the terms and conditions specified by the Bureau and extend necessary assistance/co- operation to the Bureau in case of any enquiry to be made by it.

7. I/We authorise the Bureau of Energy Efficiency for selection of sample for verification and challenge testing and agree to abide by the directions of the Bureau in this regard.

8. I/We undertake that the information supplied in this application is accurate to the best of my knowledge, and if any of the information supplied is found to be incorrect; the application may be rejected forthwith.

1. 2. This permission is subject to—

(a) the star level displayed on the label of the Stationary Storage Type Electric Water Heater shall conform to energy consumption standards for Stationary Storage Type Electric Water Heater notified under clause (a) of section 14 of the Act and terms and conditions

provided in the aforesaid regulations;

(b) the stamping of the label only on such model Stationary Storage Type Electric Water Heater for which permission has been granted;

(c) the printing and affixture of the label on the Stationary Storage Type Electric Water Heater at the cost of the permittee;

(d) the permittee ensuring that the star level displayed on the Stationary Storage Type Electric Water Heater shall be maintained at all time;

(f) the permittee furnishing to the Bureau a statement containing details of the production of the labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year. The same details shall be furnished to the Bureau also through an automated system;

(g) the permittee making available such other details of Stationary Storage type Electric Water Heater as and when sought by the Bureau of which the permission has been granted.

3. The permittee shall not withdraw the registered brand and the Stationary Storage type Electric Water Heater from the market during the validity period except with the prior approval of the Bureau.

4. The unique label series code assigned by the Bureau of Energy Efficiency for the brand is............. and should appear on the label as per the approved design.

7.
