(क) अिधिनयम क(cid:31) धारा 3 क(cid:31) उपधारा (2) के अधीन यथा उपबंिधत (cid:20)य रू ो के नाम स े उस पर वाद लाया जाएगा या वह वाद लाएगा और उसे संिवदा करने और जंगम और +थ ावर दोन(cid:10) (cid:14)कार क(cid:31) संपि$ का अज(cid:25)न, धारण और 4 ययन करने क(cid:31) शि& होगी;

(ख) अिधिनयम क(cid:31) धारा 8 क(cid:31) उपधारा (3) के अधीन यथा उपबिं धत उप+क र(cid:10) या (cid:14)6]या^ क(cid:31) बाबत ऊजा (cid:25) संर(cid:29)ण के मानक या सि_यम तय करन े के िलए उतनी संSय ा म- िवशेष‘(cid:10) क(cid:31) तकनीक(cid:31) सिमितय(cid:10) का गठन कर सकेगा िजतनी वह आव; यक समझे;

(ग) अिधिनयम क(cid:31) धारा 10 क(cid:31) उपधारा (1) के अधीन यथा उपबिं धत (cid:20)य ूरो म- उतन े अ(cid:22)य अिधका रय(cid:10) (सिचव से िभ(cid:22) न) और कम(cid:25)चा रय(cid:10) को िनयु/त कर सकेगा, िजतने वह (cid:20)य ूरो के कृMय (cid:10) के द(cid:29)तापणू (cid:25) िनव(cid:25)हन के िलए आव; यक समझे;

(घ) अिधिनयम क(cid:31) धारा 13 क(cid:31) उपधारा (1) म - यथा उपबंिधत इस अिधिनयम "ारा या इसके अधीन (cid:20)य रू ो को समनुदेिशत कृM य(cid:10) का िनव(cid:25)हन करने म - िवaमान संसाधन(cid:10) और अवसंरचना को मा(cid:22)य ता देगा और उसका उपयोग करेगा, अिभिहत उपभो/त ा^ अिभिहत अिभकरण(cid:10) और अ(cid:22)य अिभकरण(cid:10) के साथ (cid:14)भावी (cid:16)प से सम(cid:22) वय करना;

(ड.) अिधिनयम क(cid:31) धारा 13 के खbड (क) के अधीन सरकार "ारा अिधसूिचत 6कए जाने के िलए अपेि(cid:29)त (cid:14)6]या के िलए मान और ऊजा(cid:25) उपभोग मानक के िलए के(cid:22)(cid:23) ीय सरकार से िसफा रश करना;

(च) अिधिनयम क(cid:31) धारा 14क के अधीन अिभिहत उपभो/त ा^ को ऊजा (cid:25) बचत (cid:14)माण-प: जारी करन े के िलए के(cid:22) (cid:23)ीय सरकार स े िसफा रश करना; (छ) अिधिनयम क(cid:31) धारा 14 के खbड (घ) के अधीन उपकरण(cid:10) या उप+क र(cid:10) के लेबल पर (cid:14)दfशत 6कए गए िववरण(cid:10) या इनके (cid:14)दशन(cid:25) क(cid:31) रीित के बारे म - के(cid:22)(cid:23) ीय सरकार से िसफा रश करना;

(ज) अिधिनयम क(cid:31) धारा 14 के खbड (ड.) के अधीन एक अिभिहत उपभो/त ा के (cid:16)प म - ऊजा (cid:25) के 6कसी (cid:14)यो/त ा या (cid:14)यो/ ता^ के वग (cid:25) को अिधसूिचत करने के िलए के(cid:22)(cid:23) ीय सरकार से िसफा रश करना;

(झ) अिधिनयम क(cid:31) धारा 14 के खbड (त) के अधीन ऊजा(cid:25) संर(cid:29)ण िनमा(cid:25)ण संिहता के िलए उपयु/त माग(cid:25)दश(cid:25)क िसhांत िविहत करने हते ु उपाय करना; (ञ) ऊजा(cid:25) के द(cid:29) उपयोग और इसके संर(cid:29)ण के िलए जाग(cid:16)कता पैदा करन े और जानकारी का (cid:14)सार करन े के बारे म- सभी आव; यक उपाय करना;

(ट) ऊजा (cid:25) के द(cid:29) उपयोग और इसके सरं (cid:29)ण क(cid:31) तकनीक(cid:10) म - काfमक(cid:10) और िवशषे ‘(cid:10) के (cid:14)िश(cid:29)ण क(cid:31) 4य व+थ ा और उसका आयोजन करना; (ठ) ऊजा(cid:25) संर(cid:29)ण के (cid:29)े: म - परामश (cid:25) सेवा^ को सुदढ़ृ बनाना;

(ड) ऊजा(cid:25) संर(cid:29)ण के (cid:29)े: म - अनुसंधान और िवकास को बढ़ावा देना; (ढ) परी(cid:29)ण और (cid:14)माणीकरण (cid:14)6]या का िवकास और उपकरण(cid:10) तथा उप+क र(cid:10) क(cid:31) ऊजा (cid:25) क(cid:31) खपत के िलए (cid:14)माणन और परी(cid:29)ण के िलए परी(cid:29)ण सुिवधा^ को बढ़ावा देना;

(ण) ऊजा(cid:25) के द(cid:29) उपयोग और इसके संर(cid:29)ण को बढ़ावा दने े के िलए (cid:14)ायोिगक प रयोजना^ तथा (cid:14)दशन(cid:25) प रयोजना^ के काया(cid:25)(cid:22) वयन क(cid:31) सुिवधा और सू:ण; (त) ऊजा(cid:25) द(cid:29)ता (cid:14)]म, उप+ कर, उपकरण, युि&य(cid:10) और (cid:14)णािलय(cid:10) के उपयोग को बढ़ावा देना;

(थ) ऊजा(cid:25) द(cid:29)ता प रयोजना^ के नवाचारी िव$ पोषण को बढ़ावा देना; (द) ऊजा (cid:25) के द(cid:29) उपयोग और इसके संर(cid:29)ण को बढ़ावा देन े के िलए सं+थान(cid:10) को िव$ीय सहायता देना;¹Hkkx IIIµ[k.M 4º Hkkjr dk jkti=k % vlk/kj.k 3 (ध) ऊजा(cid:25) के द(cid:29) उपयोग और इसके संर(cid:29)ण को बढ़ावा देने के िलए शैि(cid:29)क सं+थ ान(cid:10), बोड,(cid:25) िव;व िवaालय(cid:10) या + वाय$ िनकाय(cid:10) के िलए शैि(cid:29)क पाjचया (cid:25) तैयार करना और उनक(cid:31) पाjचया(cid:25) म - उ/त पाj]म के समावेश के िलए सम(cid:22) वय करना;

(न) ऊजा(cid:25) (cid:14)बंधक(cid:10) और ऊजा(cid:25) लेखा परी(cid:29)क(cid:10) के (cid:14)माणन ऊजा(cid:25) संर(cid:29)ण के (cid:29)े: म- (cid:29)मता िनमा(cid:25)ण के िलए परी(cid:29)ा आयोिजत करना और सेवा^ को सुदढ़ृ बनाना;

(प) के(cid:22) (cid:23)ीय सरकार "ारा (cid:20) यरू ो को सkपे गए ऊजा(cid:25) के द(cid:29) उपयोग और इसके संर(cid:29)ण को बढ़ावा देन े के िलए अंतरराC lीय सहयोग काय(cid:25)]म(cid:10) को काया(cid:25)ि(cid:22)वत करना;

(2) अिधिनयम क(cid:31) धारा 52 के अधीन महािनदेशक को (cid:20)य ूरो के िलए यथा अपेि(cid:29)त आव;य क जानकारी पाने क(cid:31) शि& होगी।

NOTIFICATION New Delhi, the 13th February, 2017.

No. 2/11(3)/13-BEE.—Whereas the following draft of certain regulations, which the Bureau of Energy Efficiency, with the previous approval of the Central Government, proposes to make in exercise of the powers conferred by clause (c) of sub-section (2) of section 58 read with sub-section (6) of section 9 of the Energy Conservation Act, 2001 (52 of 2001), is hereby published, as required by sub-section (1) of section 58 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft regulations shall be taken into consideration on or after the expiry of a period of thirty days from the date on which copies of the Official Gazette in which this notification is published are made available to the public;

Objections or suggestions, if any, may be addressed to the Secretary, Bureau of Energy Efficiency, 4th Floor, Sewa Bhawan, R.K. Puram, New Delhi 110066;

The objections and suggestions, which may be received from any person with respect to the said draft regulations before the expiry of the period specified above, will be considered by the aforesaid Authority.

1. Short Title and Commencement – (1) These regulations may be called the Bureau of Energy Efficiency (Powers and Duties of Director-General of the Bureau) Regulations, 2017.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2. Definitions.- (1) In these regulations, unless the context otherwise requires,-

(a) “Act” means the Energy Conservation Act, 2001 (52 of 2001);

(b) “Bureau” means the Bureau of Energy Efficiency, established under sub-section (1) of section 3 of the Act;

(c) “Chairperson” means the ex-officio Chairperson of the Governing Council specified in clause (a) of sub-

section (2) of section 4 of the Act;

(d) “Chief Executive Authority” means the Director-General of the Bureau;

(e) “Secretary” means the Secretary of the Bureau.

(2) Words and expressions used in these regulations and not defined, but defined in the Act, or the rules framed under the Act shall have the meanings respectively assigned to them in the Act and the rules.

3. Delegation of powers and functions of Bureau to Director-General – (1) Subject to general superintendence, direction and management of the affairs by the Governing Council, the Director-General shall as the Chief Executive Authority of the Bureau, discharge the functions and exercise the powers of the Bureau as are specified below in accordance with the provisions of the Act, namely:-4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC. 4]

(a) acquire, hold and dispose of property, both movable and immovable, and to contract, and shall, sue or be sued in the name of the Bureau as provided under sub-section (2) of section 3 of the Act;

(b) constitute such number of technical committees of experts for the formulation of energy consumption standards or norms in respect of equipment or processes, as considered necessary as provided under sub-section (3) of section 8 of the Act;

(c) appoint officers (other than Secretary) and other employees in the Bureau as are considered necessary for the efficient discharge of functions of the Bureau, under sub-section (1) of section 10 of the Act;

(d) co-ordinate effectively with designated consumers, designated agencies and other agencies, recognise and utilise the existing resources and infrastructure, in performing the functions assigned to Bureau by or under the Act, as provided under sub-section (1) of section 13 of the Act;

(e) recommend to the Central Government the norms for processes and energy consumption standards, required to be notified by that Government under clause (a) of section 13 of the Act;

(f) recommend to the Central Government for issue of energy saving certificates to the designated consumers under section 14A of the Act;

(g) recommend to the Central Government the particulars required to be displayed on label on equipment or on appliances and the manner of their display under clause (d) of section 14 of the Act;

(h) recommend to the Central Government for notifying any user or class of users of energy as a designated consumer under clause (e) of section 14 of the Act;

(i) take suitable steps to prescribe guidelines for energy conservation building codes under clause (p) of

section 14 of the Act;

(j) take all measures necessary to create awareness and disseminate information for efficient use of energy and its conservation;

(k) arrange and organise training of personnel and specialists in the techniques for efficient use of energy and its conservation;

(l) strengthen consultancy services in the field of energy conservation;

(m) promote research and development in the field of energy conservation;

(n) develop testing and certification procedure and promote testing facilities for certification and testing for energy consumption of equipment and appliances;

(o) formulate and facilitate implementation of pilot projects and demonstration projects for promotion of efficient use of energy and its conservation;

(p) promote use of energy efficient process, equipment, devices and systems;

(q) promote innovative financing of energy efficiency projects;

(r) give financial assistance to institutions for promoting efficient use of energy and its conservation;

(s) prepare educational curriculum on efficient use of energy and its conservation for educational institutions, boards, universities or autonomous bodies and coordinate with them for inclusion of such curriculum in their syllabus;

(t) conduct examination for capacity building and strengthening of services in the field of energy conservation including certification of energy mangers and energy auditors;

(u) implement international co-operation programmes relating to efficient use of energy and its conservation as may be assigned to the Bureau by the Central Government.

(2) The Director-General shall have power to obtain information as may be required by the Bureau under

section 52 of the Act.

(3) The Director-General shall, in addition to discharging the functions and exercising the powers, of the Bureau, as are specified in these regulations, perform such other duties and exercise powers as may be delegated to him from time to time by the Governing Council of the Bureau as provided under section 51 of the Act.
